We have seen T-Mobile CEO John Legg testify in court that Sprint would be sold within two years without it, an idea for Sprint executives to take the oath of office. Before Sprint, Marcelo Claure vowed that Sprint could survive without a merger, but it had to raise prices and borrow more money. Now, Charles Egan, chairman of Dish Network, plans to defend the $26.5 billion T-Mobile-Sprint merger, which has been approved by FCC and DOJ. But to close the deal, the defendant must win a jury-less trial in a Manhattan court.

Elgen has been very active in the T-Mobile-Sprint merger, which we will discuss later. According to Fox Business News, Elgen will testify in support of the merger, arguing that plaintiffs made up of 13 state attorneys general and AG in Washington, D.C., should not be allowed. After the merger, Dish will spend $5 billion to acquire all of Sprint's prepaid services, including Boost and Virgin Mobile. It includes 9.3 million Boost customers and 7500 retail stores. Dish will also receive the 14MHz of the Sprint 800 MHz low-band spectrum and will sign a seven-year MVNO agreement with T-Mobile. This will enable Dish to start selling wireless services in its own name while building a separate 5G network. It has agreed to cover 70 per cent of 5G services by 2023, otherwise it will be fined $2.2 billion.

A person familiar with how Elgen prepared his testimony told Fox that the executive would be sworn in and that Deiss would replace Sprint as the fourth-largest aircraft carrier on the "first day" and is expected to be in early 2020. The plaintiffs argued that Dish and Ergen could not be expected to replace Sprint after the merger. The lawyer's main complaint is that by canceling Sprint, the number of major wireless providers will be reduced by 25%, and prices will rise. The plaintiffs have been trying to compare Sprint's tragic experience with T-Mobile in 2011. They think that if T-Mobile can turn things around, so can Sprint. However, this argument fails to make two points. One of them is part of a merger with ATT, which was blocked by the Ministry of Justice. T-Mobile received sweet comfort from ATT, including $3 billion, a 7-year 3G roaming agreement and 128 AWS markets. The following year, the company appointed John Legg as CEO. Although Sprint does have a rich parent company in Softbank Corp., there is only one John Legg.

Elgen has always wanted to enter the wireless market. Dish was one of the biggest winners of the 2017 FCC low-band 600MHz spectrum auction. Through its next bid with Comcast, T-Mobile won a 31-megahertz radio broadcast for $7.99 billion. But even before that, Ergen let Dish participate in this fierce Sprint event as early as 2013. On the one hand, satellite TV providers offered $25.5 billion for the airline, but lost to Softbank Corp.. The latter owns 80% of the company.

The trial was presided over by Victor Marrero, Senior Magistrate of the Southern District of New York. The judge took control of the fate of the merger. T-Mobile is looking to acquire Sprint to acquire its 2.5GHz mid-band. Combined with operators' 600MHz radio waves and some ultra-high millimeter wave spectrum, T-Mobile will be able to improve the national 5G network, which was launched earlier this month. With Sprint's intermediate frequency spectrum, T-Mobile will be able to cover rural areas with faster 5G signals. Legere testified last week that using Sprint's spectrum, T-Mobile would "triple the total capacity of independent T-Mobile and Sprint 5G". If the deal is not completed, T-Mobile will "run out of time in the next two to four years", he added.
