Yin so-and-so accidentally found that after his voice had been turned into AI, it was sold to the outside world under the name of "Magic Xiaoxuan" on an App called "Magic Voice Workshop."

Therefore, Yin sued the five defendants, including Beijing Xiaowen Intelligent Technology Co., Ltd., the operator of the "Magic Voice Workshop" to the Beijing Internet Court on the grounds that the defendant's behavior infringed upon his voice rights.

The plaintiff believes that the dubbing works of others using the plaintiff's voice have been widely circulated on Douyin, Live Bar and other App. Among them, Douyin user Xiao he Kan has released a total of 119 works using the plaintiff's voice since September 7, 2021. After sound screening and tracing, it is found that the voice in the above sound works comes from the "magic sound workshop" App operated by the defendant Beijing Xiaowen Intelligent Technology Co., Ltd.

The defendant Zhongguang Audio (Beijing) Culture Media Co., Ltd. handed over the audio of the three books recorded by the plaintiff to the defendant Microsoft (China) Co., Ltd., which AI the plaintiff's voice and authorized the sale to the defendant Shanghai Blue Cloud Network Technology Co., Ltd. and the defendant Beijing Cigna Times Technology Development Co., Ltd.

However, the plaintiff has never authorized any third person to AI the recorded voice and sell it to the outside world. The above-mentioned defendant's behavior has seriously violated the plaintiff's voice right and should bear the tort liability of stopping the infringement, apologizing and compensating the plaintiff for economic and mental loss.

All the five defendants denied the infringement. Beijing Xiaowen Intelligent Technology Co., Ltd. believes that the sound products in its App have legal sources and come from Microsoft (China) Co., Ltd.

Microsoft (China) Co., Ltd. said the voice it used came from Zhongguang Audio (Beijing) Culture Media Co., Ltd. Zhongguang Audio (Beijing) Culture Media Co., Ltd. believes that it has cooperated with the plaintiff and agreed that the copyright of the work recorded by the plaintiff belongs to it. Shanghai Blue Cloud Network Technology Co., Ltd. and Beijing Cigna Times Technology Development Co., Ltd., argue that they are the platform operator of Microsoft China and the distributor of the products involved, respectively, and do not constitute infringement.

In the final statement, the plaintiff believes that the factual basis of the claim in this case is the infringement of personality rights, not copyright infringement, and it should not be based on the fact that the defendant has the authorization of the plaintiff on copyright, and of course it is presumed that the defendant has the authorization of the personality right of the plaintiff.
