U.S. District Judge Donald Molloy (Donald Molloy) issued a preliminary injunction on Thursday to prevent Montana from enforcing a TikTok ban. Molloy believes that the ban is clearly not intended to protect consumers in Montana, but against foreign governments. In May, Greg Gianforte, the Republican governor of Montana, signed a law banning the use of TikTok,2024 on a statewide basis, effective January 1. The ban greatly exceeds the more limited rules previously passed by more than 30 states and federal agencies to ban the use of TikTok only on government-owned equipment and networks.
Subsequently, TikTok and five Montana TikTok creators sued Montana separately, and the two lawsuits were later merged. They said the ban violated users' first Amendment rights by accusing TikTok of wrongdoing without evidence. TikTok said it did not share data with foreign governments.
