In the case against Ireland and Apple, the European Commission accused Ireland of giving Apple an unfair competitive advantage through tax breaks. The European Commission said in its 2016 decision that Apple had benefited from two tax rulings in Ireland for more than 20 years, which artificially reduced its tax burden, even as low as 0.005% in 2014.

The lower court upheld Apple in 2020, arguing that regulators had not proved that Apple enjoyed an unfair advantage. But now an adviser to the European Supreme Court said on Thursday that a lower court that supported Apple had made a series of legal mistakes in hearing the case and should reopen the case.

Giovanni Petruzela, an adviser to the European Court of Justice (CJEU), said CJEU judges should overturn the lower court's decision and send the case back to the lower court. He said the lower courts had made a series of legal mistakes and had not been able to "correctly assess the nature and consequences of certain methodological errors that invalidated tax decisions according to the decision of the European Commission".

The European Union's Supreme Court will issue a binding ruling in the coming months.
