CTOnews.com Sept. 30, the Brazilian court approved the expert report of the digital video company DivX and enforced the previous preliminary injunction against Netflix, ordering Netflix to pay the court an accrued and retroactive fine of about US $3.27 million (CTOnews.com Note: currently about 23.871 million yuan). The case will now enter the full trial stage.

It is understood that DivX sued Netflix for infringement of its patent number PI 0506163-6, which is aimed at the "deblocking" tool implemented in efficient video coding (HEVC) coding files. DivX said Netflix's streaming in HEVC infringed the patent.

CTOnews.com noted that in a briefing to the court to enforce the preliminary injunction, DivX said the case was "the longest patent infringement lawsuit in Brazil in the field of information technology" and had been filed in October 2020, and that the delay "can only be attributed to deliberate delay by the defendant." The temporary ban was issued in November 2020 and was confirmed after revision in May 2022. Although Netflix was ordered to deposit the amount of the accrued fine in an account, it appealed and the court withheld the deposit until it could prove the actual violation.

DivX said the ruling was "an important message from the Brazilian judiciary to Netflix and all other companies that believe they can infringe Brazilian patents with impunity." According to the translated documents, the company also noted the court's warning that "disrespectful behavior" would lead to additional penalties.
