At present, many people will encounter subscription messages (including event notifications, points exchange, hot spots, etc.) pushed by various platforms, which usually set unsubscription methods, such as replying to "T", "TD" and "unsubscribing".

However, by default, the charging mechanism of communication operators requires that the SMS fee of unsubscribing should be deducted by the user (the sender of the SMS), thus causing the 0.1 yuan to become the fee that users have to bear in order to unsubscribe to such SMS.

According to the report, the netizen put forward two suggestions to this end:

The unified unsubscription instruction for all push messages is "TD".

The relevant departments at all levels shall make it clear who will bear the charges arising from the "TD" of unsubscribing SMS messages. In order to protect the rights and interests of users and reduce the harassment of SMS messages, the 0.1RMB fee for unsubscribing SMS messages shall be borne by the original message pushers.

In response, the Ministry of Industry and Information Technology replied, "your suggestion has been received. Thank you for your concern and valuable comments on garbage information management. We will seriously study your proposal and incorporate it into the overall consideration of the next step of work, so as to effectively safeguard the legitimate rights and interests of the broad masses of the people!"

Tuyuan Pexels and CTOnews.com previously reported that on February 25, 2022, the Ouhai District Court of Wenzhou ruled on a lawsuit caused by a merchant's marketing text message. Mr. Wang, a citizen of Wenzhou, sued a Wenzhou Food Co., Ltd. (hereinafter referred to as a food company) for marketing SMS infringement.

On April 11, 2020, Mr. Wang's mobile phone received a marketing text message from the food company, so he called the merchant and asked not to send similar text messages again. But on April 9 and 10, 2021, Mr. Wang's mobile phone received marketing messages from the food company for two days in a row. Mr. Wang replied to "T" to unsubscribe according to the prompt of the short message.

On June 12 and September 18, Mr. Wang's mobile phone received a promotional text message from the same food company. After calling, the merchant said it was sent by a third party.

So Mr. Wang chose to sue, asking the defendant company to bear the SMS fee of 0.1 yuan, double compensation for the loss of 499.8 yuan for text messages, 5 yuan for mental damage, and 4500 yuan for transportation expenses, late work expenses, printing fees and so on.

The Ouhai Court found that the defendant Food Company sent advertising messages to the plaintiff Mr. Wang many times without consent, which constituted an act of disturbing the peace of life of others. It was finally ruled that the defendant Food Company apologized to Mr. Wang in writing and paid the SMS withdrawal fee for a loss of 0.1 yuan and other reasonable expenses of 9.9 yuan.
