The use of face recognition technology in public places and business places for remote and senseless identification of specific natural persons shall be necessary for the maintenance of national security, public safety or for the protection of the life, health and property safety of natural persons in case of emergency, and shall be put forward by individuals or interested parties.

The draft for soliciting opinions stipulates that if face recognition technology is used to deal with the face information of minors under the age of 14, the separate or written consent of the parents or other guardians of the minors shall be obtained. Users of face recognition technology who use face recognition technology in public places or store face information of more than 10,000 people shall report to the network information department at or above the municipal level for the record. Except for legal conditions or individual consent, original face images, pictures and videos shall not be preserved, except for face information that has been anonymized. When using face recognition technology to process face information, the impact of personal information protection should be assessed in advance, and the processing should be recorded.
