With regard to related items, items that meet the following characteristics may not be exported without permission:

An aero-engine with a maximum continuous power of more than 16 kilowatts (kW) designed for specific unmanned aerial vehicles or unmanned airships

The loads that meet certain technical specifications are specially used for specific unmanned aerial vehicles or unmanned airships, including infrared imaging equipment, synthetic aperture radar and lasers for target indication.

Notice No. 27 of 2023 on the imposition of temporary export controls on some drones

In accordance with the relevant provisions of the Export Control Law of the people's Republic of China, the Foreign Trade Law of the people's Republic of China and the Customs Law of the people's Republic of China, in order to safeguard national security and interests and with the approval of the State Council and the Central military Commission, it is decided to impose export controls on items related to specific unmanned aerial vehicles or unmanned airships. The relevant matters are announced as follows:

1. Items that meet the following characteristics may not be exported without permission:

(I) Aeroengines with a maximum continuous power exceeding 16 kilowatts (kW) dedicated to specific unmanned aerial vehicles or airships (reference Customs commodity numbers: 8501200010, 8501320010, 8501330010, 8501340010, 8501400010, 8501520010, 8501530010, 8407101010, 8407102010, 8408909230, 8408909320, 8411111010, 8411119010, 8411121010, 8411210010, 8411221010, 8411222010, 8411223010, 8411810002).

(2) loads specifically used for specific unmanned aerial vehicles or unmanned airships that meet certain technical specifications, including infrared imaging equipment, synthetic aperture radar and lasers for target indication.

1. Infrared imaging equipment with any of the following characteristics (refer to customs commodity numbers: 8525891110, 8525892110, 8525893110):

(1) the wavelength ranges from 780nm (nm) to 30000 nm (nm).

(2) the instantaneous angle of view (IFOV) is less than 2.5mRadian (mrad).

two。 Synthetic Aperture Radar (SAR) with a range greater than 5 km (km) and with any of the following characteristics (refer to Customs commodity code: 8526109011):

(1) the resolution of stripe mode is better than 0.3 m (m).

(2) the resolution of bunching mode is better than 0.1 m (m).

3. A laser for target indication that can work stably in an environment above 55 degrees Celsius (℃) and has any of the following characteristics (refer to customs article number: 9013200093):

(2) Energy greater than 80 millijoules (mJ)

(3) the stability is better than 15%

(4) the beam divergence angle is less than 0.3mRadian (mrad).

(III) Radio communication equipment dedicated to specific unmanned aerial vehicles or unmanned airships with any of the following characteristics (refer to customs commodity codes: 8517629910, 8517691002, 8526920010):

1. Wireless TV is more than 50 kilometers away from transmission (km)

two。 The ability to control multiple machines in one station is more than 10.

(4) Civil anti-UAV system:

1. Anti-UAV electronic jamming equipment with a jamming range of more than 5 km (km) (refer to customs commodity code: 8543709960)

two。 Designed for high-power lasers with an output power of more than 1.5kW (kW) for anti-UAV systems (refer to customs product code: 9013200093).

Technical note: "specific unmanned aircraft or unmanned airships" refers to unmanned aerial vehicles or unmanned airships that meet the conditions set out in paragraph 1.1 of the announcement No. 31 of 2015 ("notice on strengthening the Export Control of some dual-use items") issued by the Ministry of Commerce and the General Administration of Customs.

2. Export operators shall go through the formalities of export license in accordance with the relevant provisions, submit an application to the Ministry of Commerce through the competent department of commerce at the provincial level, fill in the application form for the export of dual-use items and technologies and submit the following documents:

(1) the original of the export contract or agreement or the photocopies or scanned copies consistent with the original

(2) Technical description or inspection report of the items to be exported

(III) end-user and end-use certificate

(IV) introduction of importers and end-users

(5) the identity certificate of the legal representative, the main business manager and the manager of the applicant.

3. The Ministry of Commerce shall conduct an examination from the date of receipt of the export application documents, or conduct an examination jointly with the relevant departments, and make a decision on whether to grant or disapprove the license within the legal time limit.

The export of the items listed in this announcement that have a significant impact on national security shall be submitted by the Ministry of Commerce together with the relevant departments to the State Council for approval.

4. If the license is granted after examination, the Ministry of Commerce shall issue the export license for dual-use items and technologies (hereinafter referred to as the export license).

5. the procedures for applying for and issuing export licenses, the handling of special circumstances, the number of years of preservation of documents, etc., shall be implemented in accordance with the relevant provisions of decree No. 29 of 2005 of the Ministry of Commerce and the General Administration of Customs (measures for the Administration of Import and Export licenses for dual-use items and Technologies).

6. Export operators shall issue export licenses to the Customs, go through customs formalities in accordance with the provisions of the Customs Law of the people's Republic of China, and be subject to customs supervision. The customs shall go through the formalities of inspection and release on the strength of the export license issued by the Ministry of Commerce.

7. Export operators who export without license, export beyond the scope of the license or commit other illegal circumstances shall be given administrative penalties by the Ministry of Commerce or the Customs and Excise Department in accordance with the provisions of relevant laws and regulations. If the case constitutes a crime, criminal responsibility shall be investigated according to law.

8. This announcement shall be formally implemented as of September 1, 2023.

During the period of temporary control, all unmanned aerial vehicles whose targets do not meet the existing control targets and those specified in Article 1, export operators who know or should know that the export will be used for the proliferation of weapons of mass destruction, terrorist activities or military purposes shall not be exported.
