CTOnews.com, July 27 (Xinhua)-- A judge in the United States has ruled that the practice of allowing gambling applications to be put on the shelves of tech giants such as Apple, Meta and Google in their app stores is equivalent to making a profit from gambling and can be regarded as a "bookie". But the boundaries of the decision were so blurred that even the judge himself invited the companies to appeal.

Apple has been repeatedly accused of promoting or profiting from allowing gambling apps on its app store, triggering two lawsuits in 2021 alone. In February 2022, U.S. District Judge Edward J. Davila ruled that Section 230 of the Communications Code Act did not protect these companies from charges that they were actually gaming companies.

However, Judge Davila described the case as a "special case" in which "rational people may have different views on the outcome". He invited Apple, Meta and Google to appeal immediately in order to "advance this lawsuit and avoid unnecessary litigation".

The three companies have now accepted the invitation and filed so-called cross-appeals against the allegations, Reuters reported. Google did not use the word "bookie" in its appeal documents, while two other companies did.

However, all three companies agreed that Judge Davila had misinterpreted a key precedent and claimed that the impact would be huge if the mistake was not corrected on appeal. Apple's lawyers said the impact on its business would be "unlimited" because the ruling would require it to monitor the use of payments within each app-and across countries with different laws and requirements. "this is far beyond the scope of monitoring," Apple's appeal document said.

According to CTOnews.com, these appeal documents are only the beginning of a lengthy appeal process and are not expected to end until December 2023.
