Shulou(Shulou.com)11/24 Report--
With two lawsuits a day, ChatGPT is now in big trouble.
The reason has to do with the data.
First, 16 people filed an anonymous lawsuit against OpenAI and Microsoft, alleging that they used and leaked personal privacy data without permission, resulting in claims of up to $3 billion.
Then, two full-time authors suggested that OpenAI used their novel training ChatGPT without permission, which constitutes an infringement.
And plaintiffs on both sides said that OpenAI had seized too much data from the Internet, and that in addition to them, a large number of people's data were being illegally used.
There is a lot of discussion on the Internet, and some people say that writers should protect their rights and get appropriate remuneration.
But others believe that generative AI learning Internet data is like a student visiting a work of art and should choose to be open.
Both lawsuits have now been filed in federal court in San Francisco, California.
The defense OpenAI did not respond publicly for the time being.
16 people claim 3 billion. Let's take a look at the first lawsuit.
On June 28, 16 anonymous people sued OpenAI and Microsoft, claiming that ChatGPT-based AI products collected and leaked their personal information without telling or obtaining their consent.
This behavior violates the laws and policies related to AI model data and is not paid for.
They crawled 300 billion words from the Internet, books, articles, websites and posts, including personal information obtained without permission.
This includes account information, name, contact information, email, payment information, transaction history, browser data, social media information, chat data, cookie, and so on.
This allows personal information to be embedded in their AI products, which can reflect their hobbies, opinions, work resumes and even family photos.
The plaintiffs argued that OpenAI failed to adequately filter the sensitive information, putting millions of people at risk of information disclosure.
And they accused OpenAI of grabbing data as above, which was done "in secret" and was not registered as a data agent as required by applicable law.
Clarkson, the law firm responsible for the lawsuit, has previously been responsible for large-scale class-action lawsuits on issues such as data breaches and false advertising.
But it is uncertain whether the case will be won or not.
Katherine Katherine Gardner, an intellectual property lawyer, said that when users upload content to social networking platforms or other sites, they grant the platform a wide range of licenses to use their content.
Therefore, it is challenging for ordinary users to get compensation for the data acquisition of AI model.
And it has been found that in this 157page lawsuit, there are a large number of media and academic discussions and warnings on AI ethics, but there are few specific cases that have a practical impact.
On the other hand, two American writers sued OpenAI on the same day, arguing that their work was used to train ChatGPT.
The concrete evidence is that ChatGPT can produce "very accurate" abstracts for their books, which is enough to show that these books are included in the database.
Paul Tremblay Tremblay and Mona Awad say ChatGPT infringes the authors' copyright by copying data from thousands of books without permission.
The indictment estimates that OpenAI's training data contain at least 300000 books, many of them from infringing websites.
For example, when OpenAI disclosed the GPT-3 training data, it said it included two Internet book corpora, accounting for about 15%. The authors of the complaint believe that the data are from shadow library websites, such as Library Genesis and Sci-Hub.
And in 2018, OpenAI revealed that the data they fed to GPT-1 included 7000 novels. The prosecution believes that the books were copied by researchers from pirated websites without the consent or authorization of the author.
At present, there is no public response from OpenAI.
In fact, since the generative AI fire, it is not uncommon for AI to eat copyright and data privacy lawsuits.
OpenAI has been mired in a data storm as early as November last year, when the code assistant Copilot, launched by OpenAI and GitHub, was sued by programmers.
The plaintiffs sued the court for $9 billion, arguing that Copilot infringed the copyright of many original code authors as well as leaked users' privacy.
But so far, the case has not been finalized.
On the other side of AI painting, Stability AI, Midjourney and others are also involved in lawsuits.
Finding that a personal style of painting could be generated by simply typing his name, painter Kelly McConan (Kelly McKernan) joined two other creators in a lawsuit.
The legal team is the same as the one who sued Copilot.
And the website platform is also unwilling to be whoring data.
Musk recently restricted Twitter, giving the reason that he "doesn't want AI whoring data anymore." At present, the restrictions are still being implemented, and it is not known what will happen in the future.
Reddit said that the data on its own platform is very valuable, so it launched a paid API, the price is not low, this operation led to the closure of many third-party applications.
In a word, after the large-scale data crawling training on the network by AI, the privacy security and copyright problems emerge one after another, and more and more people are involved.
But at present, how to calculate the copyright issue, the industry has not yet formed a definite norm.
Only Japan has reported that there will be no copyright protection for the data used in training AI, because this will accelerate the development of AI.
