CTOnews.com noted that the notice requires operators of ride-hailing aggregation services to implement new business type platform enterprise share "Sunshine Action", disclose pricing rules, and display the percentage of each order in real time on the driver side; it is clear that they cannot use their market position to exclude and restrict competition from the transactions and prices of ride-hailing enterprises on the platform.

The operator of online car-hailing aggregation service refers to the e-commerce platform that relies on the Internet platform with technology and user traffic to provide online ride-hailing services for ride-hailing enterprises, drivers and passengers, and jointly provides online ride-hailing services with online ride-hailing enterprises within the platform, such as Gaode car-hailing, Baidu car-hailing, Ctrip, Meituan car-hailing, Tencent travel and so on. At present, there are 17 such platforms in Guangzhou, and daily orders account for an increasing proportion.

It is understood that in recent years, some aggregation service operators have engaged in ride-hailing operations in disguise in order to evade supervision, bringing a large number of unlicensed ride-hailing vehicles and drivers into the name of small ride-hailing enterprises in the platform. after the occurrence of division-enterprise disputes and ride-hailing disputes, all the responsibility is shifted to small ride-hailing enterprises, so it is difficult to protect the legitimate rights and interests of drivers and passengers. In addition, some aggregation service operators also make use of their market position, making use of data and algorithms, technology, capital advantages, service agreements, transaction rules and other means, unreasonable restrictions or conditions are imposed on the transactions, display order and transaction prices of ride-hailing enterprises on the platform, or unreasonable fees are charged from ride-hailing enterprises on the platform. These behaviors have seriously disturbed the market order and harmed the interests of consumers.

To this end, the Guangzhou Transportation Bureau issued a notice to further clarify the responsibilities and obligations of aggregation service operators and standardize the business behavior of online ride-hailing aggregation services. The notice requires the aggregation service operator to be responsible for the verification and registration of the ride-hailing enterprises on the platform, and to carry out inspection and monitoring, and should stop providing services for the enterprises in case of violations. At the same time, aggregation service operators should implement the requirements of "Sunshine Action" for transportation new business type platform enterprises, actively disclose pricing rules, reasonably set and disclose the upper limit of withdrawal ratio, and display the percentage of each order in real time on the driver side. Ride-hailing enterprises within the platform to adjust the price mechanism, at least 7 days in advance through the aggregation service operators announced to the public, subject to public supervision.

In addition, operators of ride-hailing aggregation services shall not make use of their market position, by means of data and algorithms, technology, capital advantages, service agreements, transaction rules, etc., by means of uniform price, dispatch tilt, default check, etc., to impose unreasonable restrictions or add unreasonable conditions on the transaction, display order and transaction price of ride-hailing enterprises in the platform. Or charge unreasonable fees to the online ride-hailing enterprises within the platform. Shall not interfere with the price behavior of the online ride-hailing platform company, shall not directly participate in vehicle dispatching and driver management, and maintain the market order of fair competition.

The notice shall enter into force as of the date of issuance and shall be valid for 5 years.
