CTOnews.com, June 27, two sources told Reuters yesterday that Google had urged the Supreme Court of India to rescind an antitrust order against its abuse of Android's market position.

▲ Touyuan Pexels India's Competition Commission (CCI) said last October that Google had abused its dominant position in India. Currently, 97% of the 600 million smartphones in India use the Android operating system. CCI asked Google to lift restrictions on device manufacturers, including those related to pre-installed applications. CCI also fined Google $163 million (CTOnews.com Note: currently about 1.18 billion yuan).

In March, an Indian court revoked four of the 10 orders in the case. The court said CCI's ruling on Google's anti-competitive behaviour was correct, but some of the requirements were unreasonable and were withdrawn, including hosting a third-party app store in Play Store.

Google is now asking India's Supreme Court to reverse the rest of the order, including, of course, huge fines, according to sources. In its filing yesterday, Google also argued that it had not abused its market position and should not bear the fine.

Google confirmed in a statement that it looked forward to presenting the case to the Supreme Court of India and showing how Android can benefit users and developers.

Another source said that CCI has also filed a lawsuit with the Supreme Court to seek to overturn the previous decision of the Court of Appeal to revoke the four orders. CCI has yet to comment. In line with existing directives, Google has made significant changes to its Android system in the Indian market in recent months, including allowing device manufacturers to apply for pre-installation licenses for individual applications.
