Beijing, June 27 (Xinhua)-- according to reports, the US search giant Google has been sued by lyrics site Genius for unauthorized capture and use of each other's lyrics, Genius all the way to the U.S. Supreme Court, local time on Monday, the U.S. Supreme Court ignored the company's appeal to reopen the case.

Earlier, a US grass-roots court ruled that it did not support Genius's allegation that Google violated the terms of the contract. The company refused and hoped that the US Supreme Court would rescind the ruling, but it was rejected by the US Supreme Court.

Genius, the world's largest lyrics site, has said that if Google wins the lawsuit, it will encourage American tech giants to steal content from other sites that rely on user-generated content, including online forum Reddit, peer-to-peer e-commerce site eBay, and the free Wikipedia.

Genius, which used the name "Rap Genius", has maintained a large database of lyrics. In 2019, the company sued Google in a grass-roots court in New York, alleging that Google had unauthorised lyrics from the site at the top of the search results, leaving Google with traffic that was supposed to go to Genius.

It should be pointed out that the copyright of the lyrics of the song does not belong to the Genius website, but to the music publisher or creator behind it. The Genius accusation does not involve copyright, saying that Google stole and republished the lyrics in violation of the site's user agreement.

Google spokesman Jose Castaneda thanked the U.S. Supreme Court for Monday's decision. Castaned said that Google has been authorized to use the third-party lyrics displayed by Google's search engine and will not obtain these lyrics through random web crawling.

Josh Rosenkranz, a lawyer for Genius, said they were deeply disappointed that the US Supreme Court had rejected the appeal. The lawyer said the verdict of the grass-roots court would allow large companies such as Google to irresponsibly steal content from external websites and engulf these competitors.

In the indictment, Genius said the first lyrics stolen by Google included Panda (Panda, the best rap song of 2017 on the Billboard) by American rapper Desiigner.

Genius said it used special text watermarking technology to discover Google's theft of lyrics, including rapper Kendrick Lamar, pop singers Selena Gomez and Alessia Cara.

In an appeal to the U.S. Supreme Court, the Genius website said it deliberately added special ellipsis symbols to the lyrics of some new songs, which represented the English character "RED HANDED" (which means "catch the present on the spot" in Chinese) through the translation of Morse code.

Genius said that through these special watermarks, they have evidence that Google's search engine stole the lyrics, because the "RED HANDED" information can also be seen in Google search results.

In 2022, the U.S. Second Circuit Court of Appeals in New York ruled that Genius claimed that Google violated the website service contract, but the accusation was due to concerns about the copyright of song lyrics, which could only be protected in one copyright lawsuit.

According to reports, Google once told the US second Circuit Court of Appeals that the company had obtained copyright authorization for the lyrics displayed by Google search, and that the lawsuit on Genius ignored the real rights holders of the lyrics and wanted to invent a new lyrics right through a so-called website service contract.

It is also reported that in May this year, the Biden administration advised the United States Supreme Court to reject Genius's appeal.
