According to the latest version of the AI Act passed on Wednesday, generating AI will face new transparency requirements, including publishing summaries of copyrighted materials used to train the system, a proposal supported by the publishing industry but opposed by technology developers on the grounds that it is not technically feasible. Manufacturers of generative AI systems must also take protective measures to prevent them from generating illegal content.
At the same time, the AI Act will severely restrict the use of face recognition software and require developers of AI systems such as ChatGPT chatbots to disclose more data used to create programs. The use of face recognition is a major controversial point. The European Parliament voted to ban the use of real-time face recognition, but the question remains whether legal exemptions should be allowed for national security and other law enforcement purposes.
Under the current draft, companies will face fines of up to 6 per cent of global revenues if they fail to comply with the AI Act.
The EU has gone further than the US and other Western powers in regulating AI. The EU has been debating this topic for more than two years. The issue became more urgent after the release of ChatGPT last year, adding to concerns about the potential impact of AI on employment and society.
But technology leaders have also been trying to influence the debate about AI. OpenAI CEO Sam Altman, the ChatGPT developer, has met with at least 100 US lawmakers and other global policy makers in South America, Europe, Africa and Asia in recent months, including Ursula von der Leyen, president of the European Commission. Altman has called for regulation of AI, but he also said it could be difficult for the company to comply with draft EU regulations and threatened to withdraw.
It is not clear how useful AI regulations will be. The pace of development of the AI seems to have outpaced the pace at which European lawmakers make laws. For example, early versions of the AI Act did not pay much attention to so-called generative AI systems such as ChatGPT.
