According to a complaint against Microsoft and GitHub, Copilot programming assistants in GitHub will rewrite the "common code" and output it to avoid copyright charges.

The lawsuit was first filed in November last year by four anonymous ("J. Doe") plaintiffs who claimed that Copilot used AI to train public code in ways that violated copyright law and software licensing requirements, and eventually formally "took possession" of other people's code. Microsoft and GitHub tried to dismiss the case, but in the end the judge decided that the case needed more time and allowed the plaintiff to add more details of the evidence.

According to ▲ source court documents, GitHub launched a filter called "Suggestions matching public code" in July last year. When the filter is enabled, GitHub Copilot will perform a "duplicate check" of about 150 characters with the "code suggestion" and the "common code" on GitHub. If the "duplicate check rate" is too high, the output will not be provided to users.

The plaintiffs argued that the filter was basically worthless because it only checked for exact matches and could not be detected with a slight modification. On the other hand, GitHub tries to avoid copyright and license infringement by changing the output of Copilot by "rewriting" so that the content does not appear to be copied directly.

After inquiry, CTOnews.com learned that at present, this complaint document lists a circle of charges against Microsoft and GitHub:

Violation of the Digital Millennium copyright Law

Breach of open source license

Get rich unfairly

Unfair competition

Sell license materials in violation of GitHub policy

Deliberately interfere with future economic relations

Negligence interferes with future economic relations.
