Both she and her father said the brakes failed during the accident. Tesla, on the other hand, denied the brake failure and concluded that it was the fully responsible accident caused by the owner's illegal driving. Ms. Zhang repeatedly asked Tesla for driving data before the accident, but failed. She also publicly defended her rights in March and April 2021, chanting "Tesla's brakes failed" on a crashed Model 3 and on the roof of the Shanghai auto show. Tao Lin, vice president of Tesla, once responded that Ms. Zhang's request was unreasonable and hinted that she had a team behind her.

Ms. Zhang therefore sued Tesla and Tao Lin to the Beiguan District Court in Anyang City, Henan Province, arguing that the other party had violated her reputation and personal privacy. But the court rejected her claim at first instance. Ms. Zhang said she would appeal the two cases.

Tesla sued Ms. Zhang for infringing her reputation rights. Tesla believed that Ms. Zhang's rights protection behavior at the Shanghai auto show fabricated the fact of "brake failure" and caused huge reputation damage to Tesla, so she demanded compensation of 5 million yuan. Ms. Zhang believes that Tesla did not provide complete driving data before the accident, unable to prove whether there is a hidden brake trouble, but filed a reputation lawsuit, which is blackmail and delay to her.

Ms. Zhang said that she spent 368000 yuan on Tesla, while Tesla's legal fee was 450000 yuan, which was more expensive than the car she bought. She said that the process of safeguarding rights is difficult, and the resources between consumers and car companies are not equal. Some lawyers said that in cases of infringement of the right of reputation, the amount of compensation is usually symbolic.
