April 25-the Business Software Alliance (BSA), a technology advocacy group backed by Microsoft, issued a public document on Monday, calling for rules governing the use of artificial intelligence based on national privacy legislation.

Microsoft is one of the leaders in artificial intelligence because it recently invested in artificial intelligence research company OpenAI, the creator of ChatGPT, a generative artificial intelligence (AIGC) chat robot. But Google, another key player in advanced artificial intelligence in the United States, is not a member of BSA.

BSA calls for four key protection measures:

The U.S. Congress should specify when companies must evaluate the design or impact of artificial intelligence

When artificial intelligence is used to make "big decisions", these requirements should take effect, and the U.S. Congress should define them.

The U.S. Congress should designate an existing federal agency to review whether companies have complied with the rules

Congress should require companies to develop risk management plans for high-risk artificial intelligence.

"We are an industry group and want Congress to pass legislation like this," said Craig Albright, vice president of government relations at BSA. "so we are trying to get more people to pay attention to this opportunity. We don't think artificial intelligence regulation has received the attention it deserves."

Albright added: "this is not to answer all the questions about artificial intelligence, but it is an important answer to an important question about artificial intelligence that Congress can give."

The introduction of accessible advanced artificial intelligence tools such as ChatGPT has accelerated the promotion of the technology to build a security guardrail. Although the United States has established a voluntary risk management framework, many advocates have been pushing for stronger protective measures. At the same time, Europe is trying to finalise its artificial intelligence bill to establish protective measures around high-risk artificial intelligence.

"as Europe and China advance the framework for regulation and nurturing new technologies, US policymakers need to reflect on whether digital transformation is an important part of the economic agenda," said Albright. "if so, we should have a national agenda that promotes digital transformation, which will include rules around artificial intelligence, national privacy standards and strong cyber security policies."

In a message to Congress, BSA said the bipartisan data Privacy and Protection Act, passed by the last House Energy and Commerce Committee, was the right tool for new artificial intelligence rules. Although the bill still has a long way to go before it becomes law, BSA says it already provides the right framework for the kind of national artificial intelligence guardrail that the government should build.

As many expected, BSA hopes that when the US data Privacy and Protection Act is reintroduced, it will include new rules governing artificial intelligence. Albright said the group had contacted the House Energy and Commerce Committee on their recommendations, which was "open" to many different voices.

While the US data Privacy and Protection Act still faces obstacles to becoming law, Albright said it would take a lot of effort to pass any piece of legislation. "what we want to say is that this is feasible, this is something that the two parties can agree on. So we hope that no matter how they legislate, this will be part of it."
