On the evening of April 19, Beijing time, chipmaker GlobalFoundries said today that it had filed a lawsuit against IBM, accusing it of illegally sharing confidential intellectual property rights and trade secrets.

IBM shared intellectual property rights and trade secrets with Rapidus, a Japanese semiconductor company, according to the indictment. Currently, IBM is working with Rapidus to develop and produce cutting-edge 2nm chips.

In addition, GE Core also claimed that IBM also illegally disclosed and abused its intellectual property rights to Intel. IBM announced in 2021 that it would work with Intel to promote the research of next-generation logic and packaging technology to accelerate innovation in semiconductor development and manufacturing.

"IBM may unfairly receive hundreds of millions of dollars in licensing revenue and other benefits," GE Core said in a statement. According to the indictment, GE Core worked with IBM to develop technology in Albany, New York, for decades. In 2015, GE Core was granted an exclusive license and the right to disclose these technologies.

To this end, GE Core today sought compensatory and punitive damages from IBM and asked the court to order IBM to stop using these trade secrets.

Gexin also said that IBM has been "poaching" the company's engineers. Since the announcement of its partnership with Rapidus in December 2022, IBM has accelerated the pace of poaching. Therefore, GE Core also asked the court to order the prohibition of this kind of behavior of IBM this time.

This is also the second time that GE Core has sued IBM since it acquired IBM semiconductor plant in 2015. In 2021, GE Core asked a judge to rule that the company had not breached a contract with IBM. Previously, IBM claimed US $2.5 billion from GE Core for breach of contract. A spokesman for GE Core said the lawsuit was still ongoing.
