After the verdict was pronounced in the first instance, Douyin & Johnson appealed against the verdict. The case is still under second trial.

Previously on CTOnews.com, the trademark dispute between Jinri Toutiao and Youtiao will be heard in Guangzhou intellectual property Court on April 20, 2021, and the case will be filed on September 22, 2020. The plaintiff in the first instance is Beijing byte beat Technology Co., Ltd., and the defendant in first instance is Henan Today Youtiao Restaurant Management Co., Ltd., Henan Barbecue Food Co., Ltd., and Jinshui District, Zhengzhou Youtiao breakfast restaurant. The plaintiff asked the three defendants to stop tort and unfair competition, eliminate the impact, and claim 2 million yuan.

Henan Today Youtiao Food and Beverage Management Co., Ltd. was established in May 2020, with a registered capital of 1 million yuan. Its business scope includes catering business management, food processing, etc., and has applied for registration of 16 trademarks, such as Kuaishou Cake, Cake Duoduo, tomorrow Youtiao, etc.
