CTOnews.com April 18-Nintendo wins again in the war against pirated games. Recently, Nintendo won another lawsuit against pirated game websites in the French Court of Appeal in Paris.
Defendant in the suit is Dstorage, which operates a shared-storage website called 1fichier.com that hosts a large number of unauthorized copies of Nintendo games. After discovering the pirated content, Nintendo asked Dstorage to delete or block it, but Dstorage did nothing.
As a result, Nintendo sued Dstorage in court, alleging infringement of Nintendo's intellectual property rights. In May 2021, the Paris Court of Appeal issued its first ruling in favor of Nintendo's claim. Dstorage appealed against the verdict, but still lost.
In the ruling, the court found Dstorage illegal for refusing to delete or block pirated content after receiving notice and ordered it to pay Nintendo € 442750 in damages and € 25000 in legal costs. Dstorage also has the right to appeal again, but it is unclear whether it will do so.
Nintendo expressed satisfaction with the ruling, calling it a victory for anti-piracy and the entire gaming industry. Nintendo said in a statement: "This ruling once again sends a clear message that shared storage services such as Dstorage (1fichier), which refuse to delete or block unauthorized copies of video games after receiving notice, will be legally liable and may have to pay compensation to those whose intellectual property rights have been violated." The court's determination of Dstorage's liability has implications not only for Nintendo, but for the gaming industry as a whole. It would prevent shared storage services like 1Fichier from claiming to need a prior court decision before removing pirated content, and court decisions would also confirm what rights holders must provide when notifying content that claims copyright or trademark rights are infringed. "
Nintendo has previously fought other shared-storage platform owners over similar issues. In 2021, the company won a $2.1 million lawsuit against RomUniverse.
