Shulou(Shulou.com)11/24 Report--

CTOnews.com March 27 news, now scan the code to order food has become the norm, but there are also some hidden dangers. According to recent media reports, some consumers have reported that when some restaurants scan the code to order, they are forced to provide mobile phone number and location information, otherwise they cannot place an order. After the anonymous evaluation, we also received a Wechat request from the merchant, suspected that his personal information had been leaked or sold.

According to reports, on March 6, Ms. Shi posted an anonymous bad comment on Dianping about her dining experience at a string of "experience shops (Shanghai Xujiahui Store)" called "documentary". Ms. Shi gave the store a score of 0.5 stars, but the next day a man who claimed to be "A string of Life-Service Manager Xiao du" added her Wechat by searching her mobile phone number. Ms. Shi felt uncomfortable: "even if you don't choose to comment anonymously, merchants shouldn't get my cell phone number, let alone anonymous."

Ms. Shi is not sure whether the phone number was leaked during the code-scanning order, and she suspects that Dianping App disclosed her information to the store.

In this regard, the Shanghai Consumer Protection Commission specifically asked Dianping about this matter. Dianping said that the platform is committed to presenting real and helpful evaluations and will not synchronize the personal information of evaluation users to merchants. Dianping related personage indicated that the businessman is unable to obtain the information that anonymously evaluates the user through Dianping's background. She speculates that the consumer may order by scanning the code, and the store may get the mobile phone number with the authorization. "the merchant may judge which order is based on the comments on the food, and then obtain the mobile phone number from the third party's ordering system and add it to the customer's Wechat."

On the other hand, Mr. Liao, the person in charge of the "documentary" experience store (Xujiahui store), denied that any clerk had added customer Wechat. "there is no service manager Xiao du said in the remarks of Wechat."

CTOnews.com noted that the Shanghai Consumer Protection Commission had previously conducted investigations and undercover visits and found that WeChat Mini Programs, operated by some catering enterprises, had forced consumers to order food in stores to ask for accurate information about their mobile phone numbers and users' location. These acts violate the provisions of the personal Information Protection Law and the Consumer Rights and interests Protection Law, and infringe upon the personal information rights and interests of consumers. According to the survey, 65% of consumers are unwilling to provide mobile phone numbers to merchants when ordering by scanning the code, while 56% of consumers are worried about the mandatory acquisition of location information.

The Shanghai Consumer Protection Commission believes that businesses provide code-scanning ordering service to facilitate consumers on the one hand and reduce labor costs on the other (for example, although many stores have manual ordering service, they do not have full-time ordering staff). In accordance with the provisions of the personal Information Protection Law, the collection of personal information should be limited to the minimum scope to achieve the purpose of processing, and personal information should not be collected excessively. The Law on the Protection of consumers' Rights and interests also stipulates that the collection and use of consumer personal information by operators shall follow the principles of legality, legitimacy and necessity. In order for consumers to scan the code, merchants should obtain consumers' personal information in accordance with the principle of minimum and necessity.
