The Regulations shall come into force as of June 1,2023, mainly stipulating the basic requirements for handling reports, stipulating acceptance requirements, improving handling procedures, standardizing classified handling requirements, refining handling requirements such as reply and transfer, etc.

It is clearly stipulated that the telecommunications authorities shall follow the statutory principles of authority in handling reports, take facts as the basis, take law as the criterion, and handle them fairly, fairly and efficiently. Reports are mainly handled by the Communications Administration Bureau where the reported illegal act occurs. If laws, administrative regulations and departmental rules provide otherwise, such provisions shall prevail.

It is stipulated that the handling procedure is divided into two basic links: preliminary examination and investigation. After accepting the report, the competent telecommunications department shall conduct a preliminary examination of the reported materials, and may file a case in time if it is determined that it meets the criteria for filing an administrative penalty; if it is determined that the informer is suspected of violating the telecommunications management regulations but lacks the evidence required for filing a case, it shall further investigate; if the reported problem has been settled or it can be determined that there is no relevant illegal act, it shall reply directly to the real-name informer.

According to the requirements of the regulations, the telecommunications authorities shall, within 60 days from the date of receipt of the report, make classified treatment according to the investigation. If no illegal act is found or the illegal act has exceeded the limitation period of administrative penalty, the investigation shall be terminated; if it is determined that there is an illegal act but there is no punishment, no punishment shall be imposed and correction shall be ordered; if it is determined that the standard for filing an administrative penalty is met, the case shall be filed in time according to the provisions of the Administrative Punishment Law; if the illegal act is suspected of committing a crime, the case shall be transferred to the judicial organ in time.
