CTOnews.com learned from the official account of the Shanghai Consumer Protection Commission that recently, the Shanghai Consumer Protection Commission conducted secret visits to 29 well-known milk tea restaurants and fast food restaurants and found that Mini Program, including "CoCo", "Shen Dacheng", "Tea Baidao", "7 points Sweet", "Honey Snow and Ice City", "Wangxiangyuan", "auspicious wonton" and "Shu Yi Shao Xiancao", would ask for consumers' mobile phone numbers. Among them, the problems of "CoCo" and "Shen Dacheng" are the most prominent. If consumers refuse to provide their mobile phone number, they will not be able to order. The other six can continue to order after consumers refuse.

Most code-scanning Mini Program asks consumers for location information, which is used to quickly connect with the nearest store. In this regard, the Shanghai Consumer Protection Commission believes that if consumers refuse to provide location information, businesses should also provide consumers with a way to manually select stores. In this undercover visit, the Shanghai Consumer Protection Commission found that the problem of "a little bit" is the most prominent. Consumers who use "a little bit" to order on Mini Program must provide location information in order to order, which is too overbearing. In addition, undercover visits also found that "Shen Dacheng" code-scanning Mini Program does not need to provide location information, but if consumers choose to pick up at the store, they still need to provide location information. "Burger King" sweep code-to-order Mini Program in the user refused to provide location information, although can still order, but will frequently pop up window prompts, causing interference to the normal use of consumers.

A survey of consumers conducted by the Shanghai Consumer Protection Commission found that 65% of consumers are unwilling to provide mobile phone numbers to merchants when they scan the code to order. Fifty-six percent of consumers expressed concern about the mandatory acquisition of location information by scanning the order.

The Shanghai Consumer Protection Commission believes that businesses provide code-scanning ordering service to facilitate consumers on the one hand and reduce labor costs on the other (for example, although many stores have manual ordering service, they do not have full-time ordering staff). In accordance with the provisions of the personal Information Protection Law, the collection of personal information should be limited to the minimum scope to achieve the purpose of processing, and personal information should not be collected excessively. The Law on the Protection of consumers' Rights and interests also stipulates that the collection and use of consumer personal information by operators shall follow the principles of legality, legitimacy and necessity. In order for consumers to scan the code, merchants should obtain consumers' personal information in accordance with the principle of minimum and necessity.

Before March 15, 2023, the Shanghai Consumer Protection Commission, together with the Municipal Internet Information Office and the Municipal Market Regulatory Bureau, conducted interviews with relevant enterprises to guide enterprises to rectify problems and carry out relevant law popularization education according to their respective responsibilities.
