CTOnews.com, March 8, CTOnews.com learned from the official account that recently, the Culture and Tourism Development Committee of Wanzhou District of Chongqing Municipality imposed an administrative penalty of confiscating 49000 yuan of illegal proceeds and fining 392000 yuan on the illegal act of publishing online games without authorization by a Chongqing Internet Science and Technology Co., Ltd.

According to investigation, during the period from May to May 2018, a network science and technology company in Chongqing, without obtaining the relevant qualifications such as the version number and approval number of the game publication, used a number of live webcast platforms to promote and operate an online game to users, some of which downloaded users involved minors. During the operation period, the company makes a profit by recharging by the way of platform agent.

Article 27 of the provisions on the Administration of online Publishing Services requires that before online publishing, an application must be submitted to the administrative department of publication of the province, autonomous region or municipality directly under the Central Government where it is located, and after examination and approval, it shall be submitted to the State Administration of Press, publication, Radio, Film and Television for examination and approval. Article 51 provides that engaging in online publishing services or publishing online games (including online games authorized by overseas copyright owners) without approval shall be banned by the administrative department of publication and the administrative department for industry and commerce in accordance with Article 61 of the regulations on the Administration of publication and Article 19 of the measures for the Administration of Internet Information Services. In accordance with the notice of the relevant departments, the competent telecommunications department at the provincial level shall, in accordance with the provisions of Article 19 of the measures for the Administration of Internet Information Services, impose penalties such as ordering the closure of websites. If the criminal law has been violated, criminal responsibility shall be investigated according to law; if the case is not serious enough for criminal punishment, all relevant online publications shall be deleted, the illegal gains and the main equipment and special tools engaged in illegal publishing activities shall be confiscated, and if the illegal business amount is more than 10,000 yuan, a fine of not less than 5 times and not more than 10 times the illegal business amount shall be imposed concurrently; if the illegal business amount is less than 10,000 yuan, a fine of not more than 50,000 yuan may be imposed. Whoever infringes upon the legitimate rights and interests of others shall bear civil liability according to law.
