Last month, the court announced that Audi had won the lawsuit, banning the use of the name "ES6" and "ES8" in Germany. As a result, ES7 was later renamed EL7 directly in Europe. (CTOnews.com Note: Weilai has not sold ES6 or ES8 in Germany, while the latter is only available in Norway.)

Of course, the ruling was not final, and Weilai said at the time that it would appeal the ruling and defend its legitimate rights and interests.

Although Audi has won the case so far, the two trademarks "ES6" and "ES8" are still in the hands of Weilai, so Audi asked the court to declare its trademark invalid, while the European Union intellectual property Office (EUIPO) ruled this week that NIO's ES6 and ES8 did not actually constitute confusion and rejected Audi's request.

According to court documents seen by CnEVPost, the EU intellectual property Office ruled on February 21 that there was no possibility of confusion between Weilai ES8 and ES6 and Audi's S8 and S6, so Audi's request was rejected. That means Audi seems to be losing the protracted trademark war.

In other words, unless Audi can overturn EUIPO's ruling, the ES8 and ES6 trademarks will remain valid in the European Union.
