This judgment is aimed at the patent of "positive electrode piece and battery"(patent No. 201810696957.2), and Zhongchuang Airlines was awarded a total compensation of 20.3 million yuan to Ningde Times. The court also asked China Innovation Airlines to stop selling products infringing the patent rights of the above-mentioned inventions in Ningde era. Ningde Times previously claimed a claim amount of 30.5 million yuan.

China Innovation Airlines said it would appeal the decision to the Supreme Court and that there was no need to pay compensation to Ningde Times at present. At the same time, the validity of the patent involved in the lawsuit is still in the trial of the State Intellectual Property Office.

CTOnews.com statistics found that this is the third lawsuit between Ningde Times and China Innovation Airlines. On the evening of February 20, China Innovation Airlines issued an announcement on the Hong Kong Stock Exchange. On February 20,2023, the company received the "Civil Judgment" made by Fuzhou Intermediate People's Court: it should stop selling products infringing the patent rights of Ningde Times from the effective date of the judgment; Within fifteen days from the effective date of the judgment, it shall compensate Ningde Times for the economic losses of RMB 35,800,000 Yuan and pay the expenses for the temporary protection period of invention patent of RMB 798,000 Yuan; it shall compensate Ningde Times for reasonable expenses of RMB 202,693.12 Yuan within fifteen days from the effective date of the judgment; and reject other claims of Ningde Times. China Innovation Airlines said that the court judgment will not adversely affect the company's current and future production and operation.

China Innovation Airlines also said that the judgment of this announcement is the judgment of first instance, not the final effective judgment, and will appeal to the Supreme Court on the judgment of first instance within the appeal period. It is not yet possible to determine the time and result of the final judgment. At the same time, the validity of the patent involved in the lawsuit is still in the trial of the State Intellectual Property Office. Therefore, the Company does not currently have to pay Fuzhou Intermediate People's Court a trial compensation.

Earlier in November last year, China Innovation Airlines announced that it received the Civil Judgment made by Fuzhou Intermediate People's Court on November 29,2022, making a first-instance judgment on the intellectual property infringement claim filed by Ningde Times in 2021 on "current collecting components and batteries." Ningde Times claims 12.5 million yuan from China Innovation Airlines. Finally, according to the judgment, China Innovation Airlines shall immediately stop selling products infringing the invention patent rights of Ningde era from the effective date of the judgment, and compensate Ningde era for a total of 2.96 million yuan. In response to this case, China Innovation Airlines also said that it would appeal the first-instance judgment to the Supreme Court during the appeal period.
