CTOnews.com, Feb. 22 (Reuters)-the Biden administration has decided not to overturn the import ban on Apple's Apple Watch imposed by the U.S. International Trade Commission (ITC), AliveCor said on Tuesday, according to Reuters.
A spokesman for AliveCor told Reuters that the Office of the United States Trade Representative (Office of the trade representative. Trade Representative) told the company that it would not overturn the decision made by ITC. However, Apple and AliveCor will continue to sue over infringement disputes, so they will continue to shelve ITC's previous ban on the sale of Apple Watch.
ITC ruled in December last year that Apple's technology patent used in the Apple Watch infringed AliveCor's patent and banned the import of Apple Watch. Only because the two companies launched lawsuits around patents, the relevant injunctions were shelved during the litigation. The U.S. Patent and Trademark Office ruled that the patents were invalid earlier that month, and AliveCor has said it will appeal.
Apple said Tuesday it would appeal the International Trade Commission's import ban, saying it would have a negative impact on public health.
White House representatives did not immediately respond to a request for comment Tuesday. Neither the Office of the Trade Representative nor the United States International Trade Commission could be reached for comment. The White House will decide within the next 60 days whether to overturn ITC's December 22 ruling on policy issues.

AliveCor last year accused Apple of infringing three patents related to its KardiaBand, an Apple Watch accessory that monitors a user's heart rate, detects abnormalities and performs ECG to identify heart problems such as atrial fibrillation.
AliveCor, based in Mountain View, Calif., stopped selling KardiaBand in 2018 after Apple introduced the ECG function to Apple Watch. AliveCor applied to the US International Trade Commission last year, arguing that Apple had been copying its technology since Apple Watch Series 4 and drove AliveCor out of the market by making the wearOS incompatible with KardiaBand.
Apple Watch Series 4 through Series 8 have ECG technology. On December 6, 2022, at the request of Apple, the Patent trial and Appeals Board of the United States Patent and Trademark Office invalidated the AliveCor patent in a related case. The tech giant also filed a counterclaim in San Francisco federal court on suspicion of infringing its patents.
