CTOnews.com, February 21 (Xinhua)-- A court in Beijing recently heard a case in which Youku sued Letv for infringing on its right to disseminate information on the Internet. The plaintiff claimed that the defendant unauthorised "Letv Video" software and website to provide the public with the variety show "The Smiling、Proud Wanderer season 3" online broadcast and download services, causing huge losses to the plaintiff. The plaintiff asked the court to award the defendant compensation for economic losses and lawyer fees totaling more than 6 million yuan.

The court found out that Letv Company had obtained an one-year license for the works involved in the case, but was awarded compensation for defaulting 6 million yuan in license fees. The court held that the defendant provided the online broadcasting service of the works involved in the case on his video platform without authorization, which infringed on the plaintiff's right to disseminate information on the network.

In addition, with regard to the economic loss calculation method advocated by Youku, because the works involved are variety shows with strong timeliness, the infringement occurred one year after the premiere, when the number of users watching and downloading the works involved should be in a decreasing state.

In the end, the court ordered Letv to compensate Youku for economic losses of 1 million yuan and reasonable expenses of 25000 yuan. For the plaintiff's claim of more than 6 million yuan in economic loss calculation, the court held that it was not reasonable, so the defendant only needed to pay compensation of 1 million yuan.
