CTOnews.com, Feb. 6 (Xinhua) Nintendo recently won a class action lawsuit brought by some parents who accused the company of deliberately selling defective products. The parents initially tried to sue Nintendo themselves, but abandoned their own direct lawsuit because Switch's EULA (end-user license agreement) "does not allow litigation" and requires legal arbitration. But the parents plan to continue to sue, arguing that their children are not bound by the agreement, so they can sue Nintendo.

Just three days after the class action lawsuit was first filed in 2019, an internal memo from Nintendo instructed employees in North America to start providing free repairs to Nintendo Switch Joy-Con. Although the company has taken steps to solve the problem, the parents who filed the lawsuit say the company has not done enough to solve a known problem. As a result, they have been suing. One of the mothers, Luz Sanchez, explained that the console was purchased in December, but Joy-Con had a problem in less than a month. Although there is now a free way to fix it, they believe that the fact that Nintendo knew there was a problem with the sale was enough to sue.

However, the lawsuit over Nintendo's Joy-Con was eventually dismissed. The parents' claim that their children are not bound by the end-user agreement is not true, because Nintendo won without a doubt when the parents were eventually confirmed as the true owners of Switch. Now they still have to bear the legal costs, and they could have gone straight to repair Joy-Con for free.

CTOnews.com learned that Switch has been plagued by Joy-Con joystick drift, and Nintendo has faced many other lawsuits over the same problem in the past. Before the free Joy-Con maintenance program was launched, the problem was so serious that Nintendo President Shuntaro Furukawa had to apologize for the inconvenience.
