The standing Committee of Wuxi Municipal people's Congress yesterday interpreted the main contents and characteristics of the regulations to all sectors of the community at a press conference on the regulations for the promotion of the development of the Internet of vehicles in Wuxi. It is said that Wuxi is the country's first leading area of car networking and the first batch of "Shuangzhi" pilot cities, and the infrastructure, application and industrial development of vehicle networking are in the forefront of the country.

On the whole, the regulations are divided into seven chapters and 55 articles, which mainly make comprehensive provisions from the aspects of infrastructure construction, promotion and application, technological innovation and industrial development, security, and promotion measures. it provides a strong legal support for the high-level construction of national vehicle networking pilot area in Wuxi and promoting the high-quality development of vehicle networking industry.

The regulations are clear in infrastructure construction, application promotion and quality improvement, integrated operation and autopilot. For example, it is the first time in the country to bring vehicle-road coordination infrastructure into the category of road construction projects, and for the first time to encourage and support the first application of vehicle networking and intelligent network vehicles in the fields of intelligent transportation, urban management, industry services, and so on. Chapter I General provisions

Article 4 the Municipal people's Government shall strengthen its leadership over the development and promotion of vehicle networking, incorporate the development of vehicle networking into the national economic and social development plan, formulate policies to promote the development of vehicle networking, and establish a discussion and coordination mechanism for the development of vehicle networking. coordinate and solve major problems in the promotion of vehicle networking development.

Encourage vehicle networking applications and operating enterprises to use dedicated frequencies of vehicle networking to carry out vehicle-road coordination-related applications.

Article 13 the Municipal people's Government shall comprehensively promote the construction of a unified data management and service platform for vehicle networking throughout the city, and collect and manage the real-time operation data of vehicle networking throughout the city in accordance with the law. Data related to vehicle networking, such as public security, transportation, urban management, municipal gardens, etc., shall be shared with the data management service platform of vehicle networking.

Chapter III Popularization and Application

Article 17 the people's governments of cities, counties and districts shall, on the basis of demonstration applications, promote the global application of vehicle networking technology and products, and empower the development of intelligent transportation and the construction of intelligent cities. Encourage and support relevant subjects to carry out intelligent network-connected vehicle road testing, demonstration applications, commercial operations and other activities to speed up the process of fully autonomous driving.

Article 18 the activities of intelligent network connection vehicle road test and demonstration application shall comply with the relevant provisions. The administrative measures for the application of intelligent network connection vehicle road test and demonstration shall be formulated separately by the Municipal people's Government.

Article 19 support the mutual recognition of the results of the road test and demonstration application of intelligent network-connected vehicles in different places. For the relevant subjects who have carried out or are carrying out intelligent network vehicle road test and demonstration application in other parts of the country, if the same or similar function road test or demonstration application is carried out in this city, it can be combined with the results of remote road test or demonstration application to simplify the road test and demonstration application process and project.

Article 20 encourage the exploration of business models in the process of demonstration and application of intelligent network connection vehicles.

Encourage and support market entities to use intelligent network vehicles to carry out road transport operations and other commercial operations in accordance with the law.

Article 21 the people's governments of cities, counties, districts and their relevant departments shall promote the application of vehicle networking technology and products in the fields of public transport, traffic control and intelligent parking, so as to improve the level of intelligent transport services and travel efficiency, and ensure travel safety.

Article 22 the people's governments of cities, counties and districts and their relevant departments shall take the lead in the application of intelligent network vehicles in urban management fields such as sanitation operations and road management, so as to develop in coordination with smart cities.

We will encourage and support the application of intelligent online vehicles in the fields of ferry connection, logistics and transportation, and terminal distribution, innovate smart city service application scenarios, and provide personalized and characteristic services.

Article 23 support market entities to use and develop and utilize vehicle networking data in accordance with the law according to the needs of application scenarios, provide vehicle networking data products and services on the basis of ensuring safety, expand application scenarios, and improve the level of application services.

Chapter IV technological Innovation and Industrial Development

Article 24 the people's governments of cities, counties and districts shall promote the technological innovation of vehicle networking, strengthen the basic research, applied research and transformation of technological achievements, and gradually improve the industrial technological innovation system and the supply system of common basic technologies.

Article 25 support the establishment of a market-led mechanism for tackling key core technologies with deep integration of government, industry, research and application, encourage and support enterprises, institutions of higher learning and scientific research institutes to promote key core technologies such as vehicle specification-level chips, high-precision sensing, self-driving algorithms, on-board operating systems, wire control systems, information security, and so on.

Encourage and support market players to increase investment in R & D and enhance their R & D capability.

Article 26 encourage and support the industrial application of the research achievements of major national and provincial science and technology projects and key R & D projects in the field of vehicle networking.

Article 27 encourage and support the construction of key laboratories in the field of vehicle networking, industrial innovation centers, technological innovation centers, manufacturing innovation centers and other innovation carriers.

Article 28 Scientific research institutes, institutions of higher learning, enterprises and industry associations related to vehicle networking shall be encouraged to take the lead or participate in the formulation of relevant international standards, national standards, industry standards and local standards. Support the formulation of relevant enterprise standards and group standards in accordance with the law.

Article 29 the people's governments of cities, counties and districts shall cultivate and support vehicle networking enterprises, support the construction of vehicle networking projects, and promote the development of vehicle networking industry.

The departments of industry and informatization, science and technology, and market supervision shall strengthen the monitoring of the operation of the vehicle network industry, technological innovation, the construction of the standard system and the protection of intellectual property rights, so as to improve the service level of industrial development.

Article 30 the Municipal people's Government shall promote the improvement of the industrial ecology of vehicle networking, support the development of the intelligent network in the areas of vehicle networking, such as vehicle and spare parts, on-board and roadside environmental perception, execution and control, vehicle-road coordination system, on-board operating system and self-driving software algorithm, vehicle networking information service and security, and vehicle networking communication system.

Article 31 the people's governments of cities, counties and districts shall clearly define the functional orientation of the characteristic industrial park of vehicle networking, combine the industries with characteristic advantages, support the construction of the park, promote the development of industrial agglomeration of vehicle networking, and cultivate and strengthen industrial clusters.

Article 32 the people's governments of cities, counties and districts shall promote the gradient cultivation of vehicle networking enterprises, introduce and cultivate leading enterprises in the field of vehicle networking, and support supporting cooperation between small and medium-sized enterprises and leading enterprises in the field of vehicle networking.

Article 33 encourage and support the integrated development of integrated circuit, artificial intelligence, big data, cloud computing, block chain and other information technology industries and vehicle networking industries to form diversified technologies and products.

Chapter V Security

Article 34 the municipal, county and district people's governments and their relevant departments and units shall strengthen the security and protection of vehicle networking networks, data, personal information, vehicle operation and application services, and organize to promote, guide and supervise the security and guarantee of vehicle networking.

Article 36 the Municipal people's Government shall establish a network security support platform that integrates situational awareness, risk early warning, emergency disposal and linkage command, and promotes the network security monitoring of the network of vehicles. Carry out network security threats, incident monitoring and early warning notification and security guarantee services.

The relevant subjects in the field of vehicle networking shall implement the network security level protection system, establish a network security management system and security monitoring service platform, and take technical measures and other necessary measures to improve the level of network security protection.

Article 37 the relevant entities in the field of vehicle networking shall, in accordance with the provisions of laws and regulations on data security, implement the responsibility for data security protection, carry out classified and hierarchical protection of data, and adopt technical measures such as encryption, signature, backup and other necessary measures, to ensure the confidentiality, integrity and availability of data.

Article 38 the relevant subjects in the field of vehicle networking shall, in accordance with the provisions of laws and regulations on personal information protection, establish a personal information protection system and protect personal information in accordance with the law. In dealing with personal information, the principles of legality, legitimacy, necessity and good faith shall be followed.

Article 39 personal information and important data collected and generated in the course of road testing, demonstration application and commercial operation of vehicle networking shall be stored in China in accordance with the law. If it is really necessary to provide it overseas due to business needs, a safety assessment shall be conducted in accordance with the law; if there are other provisions in laws or administrative regulations, such provisions shall prevail.

Article 40 the municipal department in charge of industry and information technology shall, in conjunction with the public security and transportation departments, delineate the road sections, areas and periods for road testing and demonstration applications according to the risk levels, and implement hierarchical management, and gradually expand the scope of road sections, regions and time periods according to the actual needs.

Intelligent Internet-connected vehicles that carry out road testing, demonstration applications and commercial operation shall, in accordance with the relevant provisions, have the functions of recording, storing and monitoring the status of the vehicle online, set up prominent signs and be equipped with emergency devices.

Traffic violations and traffic accidents that occur in the process of road testing, demonstration application and commercial operation using intelligent network-connected vehicles shall be identified and dealt with by the public security organs in accordance with road traffic safety laws and regulations.

Article 41 the compulsory insurance and commercial insurance for motor vehicle traffic accident liability insured by the application subject of intelligent network-connected automobile road test and demonstration shall comply with the relevant provisions of the State.

Article 42 the main body of the demonstration application and commercial operation of the intelligent network shall clearly indicate the possible risks to the service object and take necessary safety measures.

Chapter VI Promotion measures

Article 43 the people's governments of cities, counties, districts and their relevant departments shall innovate policies and measures to provide convenient government services for vehicle-connected enterprises and create a stable, fair, transparent and predictable business environment.

Article 44 the Municipal people's Government and its relevant departments shall gradually establish and improve the intelligent network connection vehicle operation management, commercial operation, traffic law enforcement, and supporting systems in the areas of vehicle networking network and data security, infrastructure investment, construction, operation and maintenance, and shall be responsible for organizing and implementing them.

Article 45 the people's governments of cities, counties, districts and their relevant departments shall arrange funds for the development of vehicle networking and special funds for industry, establish diversified investment and financing mechanisms, and guide social capital to participate in the development of vehicle networking.

Article 46 the people's governments of cities, counties, districts and their relevant departments shall strengthen the construction of public service platforms such as test bases and product quality inspection centers in the field of vehicle networking, provide basic industrial technology, testing verification, certification, intellectual property protection and operation and other public services in the field of vehicle networking, and enhance the supporting capacity of the industry.

Article 47 the people's governments of cities, counties, districts and their relevant departments shall establish and improve mechanisms for the introduction, evaluation and incentive of talents, encourage and support the introduction of high-level, high-skilled and scarce talents in the field of vehicle networking, and provide necessary support to qualified talents in housing security, health care and children's education.

Scientific research institutes, institutions of higher learning and enterprises are encouraged to introduce talents and talent teams from the vehicle network.

Scientific research institutes and colleges and universities are encouraged to meet the needs of the development of vehicle networking, promote discipline construction, carry out diversified personnel training, and improve the quality of talents.

Article 48 the municipal department in charge of industry and information technology shall, in conjunction with the municipal market supervision and other departments, organize the formulation of relevant local standards for vehicle networking, and promote the application of local standards as national standards and industry standards.

The relevant local standards of vehicle networking shall be in line with the development direction of vehicle networking technology, shall not exclude technologies of different development paths, and shall be timely updated according to the trend of technological development.

Article 49 the municipal department in charge of industry and information technology shall regularly issue reports on the development of vehicle networking, reflecting the development index and trend of vehicle networking, and guiding the development direction of vehicle networking.

Article 50 Financial institutions are encouraged to innovate ways of financing support and develop financial products suitable for the development of the vehicle Internet industry. We will support financial institutions to provide mortgage financing services such as production equipment and products for vehicle-connected enterprises, and provide pledge financing services for accounts receivable, intellectual property rights and other rights.

Support government financing guarantee, re-guarantee and other institutions, provide credit enhancement services for car-connected enterprises, and lower the financing threshold of enterprises.

Article 51 Insurance institutions shall be encouraged to develop insurance products in the field of vehicle networking, and provide credit insurance, guarantee insurance, intellectual property insurance, liability insurance and other insurance services for vehicle networking enterprises.

Encourage relevant social organizations and enterprises to jointly set up a social risk fund for vehicle networking, and if victims of personal and property losses caused by vehicle networking and intelligent network-related accidents cannot be compensated in time due to reasons such as the inability to identify their responsibilities, compensation shall be given in advance.

Article 52 the people's governments of cities, counties and districts and their relevant departments shall, in accordance with the principles of encouraging innovation and development and ensuring quality and safety, establish a fault-tolerant mechanism for innovation and entrepreneurship in the field of vehicle networking, inclusive and prudent supervision of new technologies, new industries, new business type and new models in the field of vehicle networking.

For those who make mistakes or deviations in the work of promoting the development of the vehicle network, meet the prescribed conditions, diligently and conscientiously, and do not seek private interests, the relevant units and individuals shall be exempted from responsibility or reduced in accordance with the law.

Article 53 encourage and support the development of various forms of vehicle networking technology and application experience activities, strengthen publicity in professional fields, and create a good atmosphere to support the construction of the pilot area of vehicle networking.

Chapter VII Supplementary provisions

Article 54 the meanings of the following terms in these regulations:

(1) vehicle networking refers to an information physical system that carries out wireless communication and information exchange in accordance with agreed communication protocols and data exchange standards on the basis of omni-directional network connections between vehicles, vehicles and roads, vehicles and people, vehicles and service platforms.

(2) Intelligent Networked vehicles, which are equipped with advanced on-board sensors, controllers, actuators and other devices, integrate modern communication and network technology, and realize intelligent information exchange and sharing between vehicles and people, vehicles, roads, clouds, etc., a new generation of vehicles with complex environment perception, intelligent decision-making, collaborative control and other functions, which can eventually replace human operation. According to the autopilot function, it can be divided into three levels: conditional autopilot, highly autopilot and fully autopilot.

Article 55 this Law shall enter into force as of March 1, 2023.
