Shulou(Shulou.com)11/24 Report--
January 20 (Xinhua) on Thursday, local time, the Supreme Court of India rejected Google's request to rescind the antitrust ruling, forcing it to change the way Android platform operates. Indian start-ups welcomed the result, saying the final ruling would open up markets and promote competition for Google's competitors.
Tuyuan Pexels in October, the Indian Competition Commission (CCI) ordered Google to make a series of changes to the way the Android platform operates, such as avoiding agreements to ensure the exclusivity of Google's search services and forcing Google apps to be pre-installed. CCI also asked Google to allow third-party app stores to enter the Play Store app store.
Earlier this month, Google filed a lawsuit in an Indian appeals court, saying that most of the decisions made by CCI were plagiarized from previous penalties imposed by the European Commission and should be rescinded. Google also said the order would harm consumers and hinder the development of India's Android ecosystem. But Google's request was quickly rejected by the Indian Court of Appeal.
Subsequently, Google appealed again to the Supreme Court of India. On Thursday, India's Supreme Court rejected Google's request to block the antitrust order. Google now needs to obey orders within seven days.
MapmyIndia, an Indian mapping service, launched an app in 2004. Rohan Verma, the company's chief executive, says the app he has developed over the years has not gained much market share because many Android phones are pre-installed with Google Maps.
CCI's order makes it impossible for Google to force its own apps to be pre-installed on Android phones in India.
"We are very happy," Wilma said. " We have been adversely affected for many years, and we hope that consumers and device manufacturers will now make more use of our applications. "
Counterpoint Research, a market research firm, estimates that there are 600 million smartphones in India, of which about 97 per cent run Android, while Apple's iPhone has only 3 per cent of the market.
Google licensed Android to smartphone makers and reached some agreements. Critics say these agreements violate market competition, but Google says it provides more options for each company, which helps keep Android free and open source.
Indus OS also operates an app store in India and competes with Google. Rakesh Deshmukh, the company's chief executive, called the ruling a "watershed moment", saying that allowing other companies to open other app stores within Play Store would provide consumers with more choices and facilitate the use and promotion of apps.
Naval Naval Chopra, a lawyer at the Indian law firm Shardul Amarchand Mangaldas, who has challenged Google's approach in court in the past, said Thursday's ruling was significant.
The CCI order "is likely to create a new Indian competitor in video hosting, maps, web browsers and even search," he said.
