CTOnews.com, January 19, the Ministry of Industry and Information Technology today announced the regulations on the Administration of ground Radio stations (stations). These provisions shall apply to the establishment and use of ground radio stations (stations) within the territory of the people's Republic of China. In accordance with these provisions, the state radio administrative agencies shall be responsible for the supervision and administration of the establishment and use of ground radio stations (stations) throughout the country, and the radio administrative agencies of provinces, autonomous regions and municipalities directly under the Central Government shall be responsible for the supervision and administration of the establishment and use of ground radio stations (stations) within their respective administrative areas in accordance with these provisions. These provisions shall enter into force as of February 1, 2023.

Article 1 in order to strengthen the management of ground radio stations (stations), maintain the order of radio waves in the air, ensure the normal operation of radio services, and ensure the safety of electromagnetic space, these provisions are formulated in accordance with the regulations of the people's Republic of China on Radio Administration and relevant laws and administrative regulations.
Article 2 these provisions shall apply to the establishment and use of ground radio stations (stations) within the territory of the people's Republic of China.
The term "ground radio station (station)" as mentioned in these provisions refers to one or more transmitters, receivers, or a combination of transmitters and receivers set up or used in a certain place or region for the development of terrestrial radio services.
The term "terrestrial radio services" as mentioned in these provisions refers to radio services other than space radio services and radio astronomy, mainly including fixed services, mobile services, broadcasting services, radio determination services, meteorological auxiliary services, standard frequency and time signal services, amateur services, security services, special services, etc.
Article 3 the state radio administrative agency shall be responsible for the supervision and administration of the establishment and use of ground radio stations (stations) throughout the country.
The radio administrative agencies of provinces, autonomous regions and municipalities directly under the Central Government shall be responsible for the supervision and administration of the establishment and use of ground radio stations within their respective administrative areas in accordance with these provisions.
The state radio administrative agencies and the radio administrative agencies of provinces, autonomous regions and municipalities directly under the Central Government are collectively referred to as radio administrative agencies.
Article 4 the establishment and use of ground radio stations (stations) other than ground public mobile communication terminals, single receiving radio stations (stations) and micro-power short-distance radio transmission equipment prescribed by the state radio administration agency shall apply for a radio station license. Where there are other provisions in laws or administrative regulations, such provisions shall prevail.
Article 5 an application for a radio station license shall meet the conditions stipulated in the regulations of the people's Republic of China on Radio Administration and submit the application in accordance with the following channels:
(1) those who set up or use ground radio stations (stations) with fixed stations shall apply to the radio administrative organs of the provinces, autonomous regions and municipalities directly under the Central Government where the radio stations (stations) are located
(2) for the establishment or use of a ground radio station (station) without a fixed address, an application shall be made to the radio administrative authority of the province, autonomous region or municipality directly under the Central Government where the applicant resides.
(3) those who set up or use shortwave ground radio stations (stations) of more than 15 watts and important ground radio stations (stations) related to national sovereignty and security shall apply to the state radio regulatory agency.
Article 6 in applying for a radio station license, the following application materials shall be submitted and shall be responsible for the authenticity and completeness of the application materials:
(1) if the applicant is a unit, the application form and the applicant's business license, ID card and other documents (photocopies) shall also submit the document materials of the manager and the power of attorney of the unit.
(2) licenses or other approval documents for the use of radio frequencies
(3) proof that the radio transmitting equipment used has obtained the type approval of the radio transmitting equipment in accordance with the law and meets the product quality requirements prescribed by the State
(4) explanatory materials for personnel who are familiar with radio management regulations and have relevant business skills
(5) specific uses and technical plans for the establishment and use of ground radio stations (stations)
(6) electromagnetic environment test report of radio station (station).
If a radio station identification code is required, an application for the use of the identification code shall be submitted at the same time.
Article 7 for those who apply for a radio station license and do not need to obtain a license for the use of radio frequencies according to law, it is not necessary to submit the materials specified in paragraph 2 of Article 6 of these provisions.
To apply for the following radio station license, the materials specified in paragraph 6 of Article 6 of these provisions may not be submitted:
(1) Radio and television ground radio stations (stations) and other radio stations (stations) that only have the function of transmitting, with the exception of ground aviation radio navigation stations (stations)
(2) ground mobile communication base stations
(3) ground radio stations (stations) without fixed stations
(4) ground radio stations (stations) that undertake not to make requirements for protection from harmful interference.
Article 8 the radio administrative agency shall examine the application materials according to law. If the application materials are not complete or do not conform to the legal form, the applicant shall be informed of all the contents that need to be supplemented and corrected at once on the spot or within 5 working days. If the application materials are not notified within the time limit, they shall be accepted from the date of receipt of the application materials; if the application materials are complete and in accordance with the legal form, or if the applicant corrects all the application materials as required, it shall be accepted and a notice of acceptance shall be issued to the applicant.
Article 9 the radio administrative agency shall, within 30 working days from the date of accepting the application, complete the examination and make a decision on approval or disapproval. If permission is granted, a radio station license shall be issued, and if it is necessary to use the radio station identification code, the radio station identification code shall be issued at the same time; if the permit is not granted, the applicant shall be notified in writing and the reasons shall be given.
If the radio administrative agency examines the application for the license of the ground radio station (station) that sets up or uses a ground radio station without a fixed station address, and finds that the use area of the radio station (station) exceeds its own administrative area, it shall consult the radio administrative authorities of the relevant provinces, autonomous regions and municipalities directly under the Central Government, and specify the requirements for use in the radio station license.
The time required by the radio regulatory agency to examine the application for a radio station license to organize hearings, testing, expert evaluation, and to carry out relevant domestic and international coordination or to perform the procedures prescribed by international rules shall not be counted within the examination period stipulated in the first paragraph of this Article, but shall inform the applicant of the time required.
Article 10 A radio station license shall specify the setting, user, address or area of use of the radio station (station), frequency of use, transmission power, bandwidth occupied, type approval code of radio transmitting equipment, period of validity, use requirements, license number, license issuing authority and issuing time, etc. At the same time, if the identification code of a radio station is issued, the identification code of the radio station shall also be clearly stated on the license of the radio station.
The type of radio station license shall be uniformly prescribed by the state radio regulatory agency.
Article 11 the period of validity of a radio station license shall not exceed the time limit stipulated in the radio frequency use license; for the establishment and use of ground radio stations (stations) that do not need to obtain a radio frequency use license according to law, the validity period of the radio station license shall not exceed 5 years.
Article 12 if it is necessary to continue to use the ground radio station (station) after the expiration of the radio station license, it shall apply for extension to the radio administrative agency that made the license decision 30 working days before the expiration of the time limit. The radio administrative agency shall conduct an examination in accordance with these provisions and make a decision on whether to extend it or not. If renewal is granted, the radio station license shall be renewed; if it is not renewed, the applicant shall be notified in writing and the reasons shall be given.
If it changes the matters specified in the radio station license, it shall go through the formalities for the change with the radio administrative agency that made the license decision.
Article 13 if a radio station license is revoked or revoked according to law, the use of ground radio stations (stations) shall be stopped immediately, the auxiliary equipment such as radio stations (stations) and antennas shall be dismantled, and the radio station license shall be returned.
If the radio station license expires or terminates the use of the ground radio station (station) for other reasons, it shall immediately stop using the ground radio station (station), and promptly go through the formalities of cancellation with the radio administrative agency that made the licensing decision, return the radio station license, and dismantle the ground radio station (station) and antenna and other ancillary equipment within 60 working days from the date of cancellation of the radio station license.
Article 14 in case of an emergency that endangers national security, public safety or the safety of life and property, or in order to ensure the special needs of major social activities, ground radio stations (stations) that should be applied for a radio station license may be temporarily set up or used without approval. However, it shall be reported to the radio administrative authority of the province, autonomous region or municipality directly under the Central Government where the ground radio station (station) is located within 5 days from the date of establishment and use of the ground radio station (station). And after the emergency is eliminated or major social activities are over, the radio stations (stations) and antennas and other ancillary equipment shall be dismantled.
Article 15 where foreign leaders visit China, embassies and consulates of various countries in China and representative offices of international organizations enjoying diplomatic privileges and immunities set up and use ground radio stations (stations) that should apply for a radio station license, it shall be approved by the state radio regulatory agency through diplomatic channels.
Where other overseas organizations or individuals set up or use ground radio stations (stations) within the territory of China that should apply for a radio station license, they shall be submitted by the relevant competent departments of business to the radio regulatory agency for approval in accordance with the provisions of Article 5 of these provisions.
Article 16 Units and individuals that use ground radio stations (stations) shall abide by the following codes of conduct:
(1) to use ground radio stations (stations) in accordance with the matters and conditions specified in the radio station license.
(2) it is not allowed to intentionally send or receive radio signals other than those permitted by the radio station license, and it is not allowed to spread, publish or make use of information received unintentionally.
(3) to maintain radio stations (stations) regularly to ensure that their performance indicators comply with national standards and relevant provisions of national radio management, and to avoid harmful interference to other radio stations (stations) that are set up or used in accordance with the law; to record the maintenance information in writing, and to provide it according to the requirements during the inspection by the radio management agency.
(4) to abide by the relevant provisions of the state on environmental protection and take necessary measures to prevent electromagnetic radiation from radio waves from polluting the environment
(5) to ensure the safe operation of radio stations (stations), improve their ability to protect against interference, and actively cooperate with other radio stations (stations) set up and used in accordance with the law when necessary.
(6) Radio stations (stations) shall not be used to carry out illegal and criminal activities
(7) laws, administrative regulations and other codes of conduct of the state radio administration.
Article 17 if a ground radio station (station) set up or used according to law suffers harmful interference, it may complain to the radio administrative agency; the radio administrative agency that accepts the complaint shall handle the complaint in time in accordance with the relevant provisions of the regulations of the people's Republic of China on Radio Administration, and inform the complainant of the handling.
Article 18 the radio administrative agency shall regularly inspect and test the ground radio stations (stations) in use. For radio and television terrestrial radio stations (stations), radar stations, microwave stations and other large radio stations (stations), the radio administrative agency shall complete the first inspection and inspection within one year from the date of commencement of the period of validity specified in the radio station license.
Article 19 Radio administrative agencies and their staff shall keep strictly confidential the communication secrets, trade secrets and personal private information that they know in the course of performing their duties, and shall not divulge or illegally provide them to others.
Article 20 whoever violates these provisions shall be ordered by the radio administrative agency to make corrections and shall be punished in accordance with laws and administrative regulations such as the Administrative license Law of the people's Republic of China and the regulations of the people's Republic of China on Radio Administration. If the act constitutes a violation of the administration of public security, it shall be handed over to the public security organ for handling; if the act constitutes a crime, it shall be handed over to the judicial organ for handling.
Article 21 if the radio administrative agency and its staff fail to perform their duties in accordance with the regulations of the people's Republic of China on Radio Administration and these provisions, the responsible leaders and other persons directly responsible shall be punished in accordance with the law.
Article 22 those who set up and use terrestrial radio stations (stations) in border areas shall also abide by the relevant requirements of the International regulations on the Coordination of Terrestrial Radio Service frequencies in Border areas.
Article 23 ground radio stations (stations) of military systems, radio stations and amateur radio stations installed and used on ships, aircraft and railway locomotives (including EMU trains) shall be carried out in accordance with the relevant provisions.
Article 24 these provisions shall enter into force as of February 1, 2023.
