In the updated document, Google said it had reached an agreement with Apple and other companies to use Google search as the default search engine, but that the agreement did not prevent other smartphone makers from promoting search engines that compete with Google.
The antitrust lawsuit, which is expected to begin trial in September this year, has attracted a lot of attention in the industry. If Google loses the case, the company may need to divest some of its business or assets.
In search, Google has faced two antitrust lawsuits in the United States, one filed by the U.S. Department of Justice in conjunction with 11 state prosecutors in 2020, and the other by prosecutors in 35 states, led by Colorado prosecutors.
At the end of last year, Google filed a document asking Judge Amit Mehta of the Federal District Court for the District of Columbia to dismiss both lawsuits alleging Google's monopoly on search services.
The lawsuit of the US Department of Justice was submitted during the Trump administration. At the time, the Justice Department accused Google of violating US antitrust laws in order to maintain its leading position in the search and online advertising market. For example, the company pays billions of dollars a year to external partners such as Apple and South Korea's LG Electronics, making Google search the default search on each other's browsers or smartphones.
In the latest update, Google said Judge Mehta should dismiss the Justice Department's lawsuit because although Google has signed default search cooperation agreements with Apple and other manufacturers, but these agreements themselves allow smartphone makers to promote other search services that compete with Google, including Microsoft's Bing search.
Google said that the popularity of Google search by browser manufacturers and consumers is entirely due to the quality of the search service. In the smartphone market, Google thinks it has the right to compete with other search services for default search status, and it is inappropriate for the US government to restrict Google from competing.
In the document, Google said that if Google is asked not to participate in the fierce (default search) market competition, or browser manufacturers are required to modify the software design, it will lead to a worse user experience. This is completely contrary to the original intention of US antitrust law.
In the past, Google has partnered with its own voice assistant, Google Assistant, and other Internet of things products and outside companies. Google said in the filing that there was no evidence that Google's cooperation undermined fair competition in the market.
In addition to the US federal government, the US state-level government has also challenged businesses such as Google search and search advertising. In 2020, prosecutors in states such as Colorado also filed antitrust lawsuits against Google.
State prosecutors have filed more "criminal" charges than the Department of Justice. For example, Google advertisers have used the official tool "search Advertising 360" to manage advertising marketing plans, but Google has illegally restricted the use of this tool by some competitors.
State prosecutors also said Google used its dominant business to crack down on competitors, such as online travel sites, in violation of antitrust laws.
