Musk had previously tweeted that all those who quit would receive a three-month severance package. However, the agreement provided only one month's basic salary as severance pay.

In the early hours of Saturday morning, former Twitter employees laid off Nov. 4 received an email from twitterseparation@cptgroup.com, which many recipients said had been classified as "spam" and, after being opened from the spam folder, directed people to a website run by CPT Group for a complete termination agreement.

"As you know, we have had to reduce our global workforce to ensure the success of the company, and your employment has been affected," the website said. Since we notified you of your status, you have been on non-work notice, employed and paid, and this will continue until your termination date. You are also eligible for additional severance pay if you sign a separation agreement and release agreement. "

Before laid-off workers receive their agreements, many are debating whether to sign an agreement giving up their rights in exchange for a month's severance pay. By contrast, when Facebook made mass layoffs in November, the company's layoffs received six months of severance pay, and Snap offered employees four months of severance pay in its layoffs at the end of August.

One person who received the agreement said they decided not to sign it, but rather participate in one of several lawsuits filed or ongoing involving Musk's alleged violations of merger agreements regarding employee benefits and separations. Dozens of other affected employees have signed agreements to participate in legal action.

Employees who were laid off or resigned around Nov. 4 are expected to receive severance packages, two people familiar with Twitter said. However, those who resigned weeks later after Musk's "hardcore Twitter 2.0" emails have so far not received agreements to sign, these sources said.

The severance agreement appears to be a template that offers a month's salary as severance pay to the fired employee. Musk tweeted on Nov. 4 that "all those fired" received three months of severance pay, which he said was 50 percent more than required by law. Musk may have counted time spent "not working," and many employees have continued to receive salaries since November while waiting for severance payments. National labor laws require companies to give notice of mass layoffs.

CTOnews.com understands that in order to receive a month's extra pay, employees who are fired must sign a contract provided that prohibits them from participating in any litigation or mass arbitration against the company, or from talking publicly or to the media about Twitter, such terms being typical of severance agreements. However, these agreements also require former employees to forgo any future stock payments or pay bonuses to which they may be entitled.
