In order to thoroughly implement the decision-making plan of the 20th CPC National Congress on deepening the reform of "release, management and service", according to the "opinions of the General Office of the State Council on deepening the Reform of the Management system of the Electronic and Electrical Appliances Industry" (State Office Fa (2022) No. 31), the Ministry of Industry and Information Technology decided to carry out the pilot work of self-examination and self-certification of radio transmitting equipment type approval (hereinafter referred to as model approval). The notice of the matter is as follows:

I. pilot content

By the end of 2022, a number of radio transmission equipment manufacturing enterprises with complete conditions, good quality management and credit will be identified to carry out the pilot project of self-examination and self-certification. When a pilot enterprise applies for model approval, in addition to special testing items such as network security, it may use its own inspection report instead of a third-party inspection report; it may, on the premise of making relevant commitments, be exempted from submitting application materials on the production capacity, technical strength and quality assurance system of the enterprise or its entrusted production enterprise.

II. Declaration conditions

According to the needs of the self-examination and self-certification work of model approval, and in line with the principles of active exploration, steady promotion and selection of the best, it is planned to select a number of enterprises nationwide to carry out the pilot work of self-examination and self-certification. In principle, the number of pilot enterprises of self-examination and self-certification in 2022 shall not exceed 5.

Enterprises applying for self-examination and self-certification shall meet the following requirements:

(1) an independent legal entity registered in accordance with the law within the territory of the people's Republic of China that can independently bear civil liability and has a fixed office.

(2) more than five years of experience in the production of radio transmitting equipment

(3) Radio business products are in the forefront of the industry in terms of production scale and market share, with independent brands, independent research and development capabilities, and sound production capacity, technical strength and quality assurance system.

(4) quality inspection departments or full-time testing personnel with relevant radio equipment shall have facilities such as test sites and test instruments that independently carry out model approval tests, and the test results shall be true, accurate, complete and traceable, and shall bear the main responsibility for the self-examination and self-certification report.

(5) the enterprise shall abide by the law and operate in good faith, with a credit rating of AA or above

(6) in the past three years, he has not received any notice from the radio regulatory agency ordering rectification or received administrative punishment.

(7) the radio transmitting equipment with self-examination and self-certification does not involve special testing items such as network security.

Enterprises with a qualified rate of 100% in the model approval supervision and sampling inspection in the past three years, which have been recognized by the China National Accreditation Committee for conformity Assessment (CNAS) in relevant fields, undertake major national special tasks, and enterprises that have won national and provincial and ministerial awards or titles in industrial and information fields such as "national technological innovation demonstration enterprises" and "specialized special new giant enterprises" may give priority to being included in the pilot enterprises of self-examination and self-certification.

III. Organizing and implementing

(1) where an enterprise that meets the conditions prescribed in this Circular voluntarily applies for self-examination and self-certification, and provides the following materials to be submitted to the radio management agency of the province (autonomous region or city) where the enterprise is registered:

1. Application for self-examination and self-certification with the official seal of the enterprise

3. The type of equipment to be applied for self-test and self-certification pilot, the corresponding equipment name, main functions, production plan, main RF technical characteristics and other explanatory materials.

4. The explanatory materials that the enterprise has the corresponding production capacity, technical force, quality assurance system and testing capability

5. Self-examination and self-certification pilot commitment (see attachment for details)

6. Other explanatory materials that meet the requirements.

(2) the radio administrative organs of each province (autonomous region and municipality) shall be responsible for organizing the declaration of the pilot enterprises within their respective administrative areas and conducting the preliminary examination of the application materials of the enterprises. In principle, there are no more than 2 pilot enterprises in each province (autonomous region and city), and no more than 3 pilot enterprises in Beijing, Shanghai, Fujian, Guangdong and Sichuan entrusted with the task of model approval test. the type of self-certification equipment declared by each enterprise is one of the third-level catalogue of the model approval service guide equipment catalogue (the space station is declared according to the first-level catalogue of satellite communication equipment).

(3) the Ministry of Industry and Information Technology shall organize experts to evaluate the application materials and put forward a proposal on the candidate list of pilot enterprises for self-examination and self-certification. On this basis, we comprehensively study and determine the list of pilot enterprises of self-examination and self-certification and the types of radio transmitting equipment. After publicity and no objection, the list of pilot enterprises and equipment types of self-examination and self-certification shall be determined and announced to the public.

(4) after entering the list of pilot enterprises for self-inspection and self-certification, the applicant enterprises shall submit application materials in accordance with the relevant provisions of radio management when applying for model approval of radio transmitting equipment. Among them, it is exempted from submitting the application materials of the production capacity, technical force and quality assurance system of the enterprise or its entrusted production enterprise, but the self-certification test report of the equipment shall be submitted. The Ministry of Industry and Information Technology examines the application materials in accordance with the law and makes a decision on whether or not to approve the model.

(5) the enterprise pilot project is valid for one year. After the expiration of the period of validity, the Ministry of Industry and Information Technology will postpone or adjust the pilot work according to the situation of the pilot work.

IV. Job requirements

(1) strengthening organizational security. Radio administrative agencies in various localities should strengthen organization and leadership, improve the working mechanism, and strengthen guidance, supervision and inspection of pilot enterprises in the region. According to the results of the pilot project, the Ministry of Industry and Information Technology has gradually improved and popularized the self-examination and self-certification system for type approval of radio transmitting equipment.

(2) to organize and implement according to law. The pilot enterprise shall abide by the relevant regulations of the state on radio management. The technical indicators, test items and test methods of the self-examination and self-certification report shall meet the requirements of the relevant provisions and standards of the state radio management. (3) to strengthen the random inspection after the certificate. Local radio administrative agencies shall, in accordance with the proportion of spot checks of not less than 20%, supervise and inspect the certified equipment of pilot enterprises after certification. At the same time, carry out on-site supervision and inspection on the production capacity, technical strength and quality assurance system of the pilot enterprises. The pilot enterprise shall keep the test samples applied for model approval for reference at any time for two years.

V. Supervision and management

(1) for enterprises that fail to pass the supervision and inspection of the equipment after the license, or whose production capacity, technical force and quality assurance system fail to meet the standards, the equipment type approval certificate and the qualification of enterprise self-examination and self-certification shall be cancelled in accordance with the law.

(2) if a pilot enterprise submits application materials or test reports by means of fraud or other means, the equipment type approval certificate and the qualification of the enterprise's self-examination and self-certification shall be cancelled according to law.

(3) those who are punished by the radio administrative agency or violate laws and regulations, resulting in serious consequences, shall be investigated and dealt with by the relevant provincial (autonomous region, municipal) radio administrative agencies in accordance with the law, and the qualification of the enterprise for self-examination and self-certification shall be cancelled.

(4) those who are disqualified from self-examination and self-certification shall not apply again within three years.
