On Friday, local time, a private jet company sued social media Twitter led by Elon Musk, alleging that the company had been in breach of contract and had been delaying the payment of two flights totaling nearly $200000.
Leslie Berland, Twitter's former chief marketing officer, used two charter flights from New Jersey to San Francisco on October 26 and October 27, respectively, according to private jet services group (PJS). At that time, Musk's $44 billion acquisition of Twitter was coming to an end, and Bolan booked a charter flight for PJS. On October 26, Musk visited Twitter's headquarters in San Francisco and completed the acquisition the next day. Mr Musk reportedly fired about half of his Twitter employees in November, including Mr Bolan. The subsequent payment came to nothing.
PJS had to file a lawsuit in the District Court of the State of New Hampshire. The private jet company said in the lawsuit that two Twitter employees booked a round-trip flight from New Jersey to San Francisco by email and text message. PJS later tweeted bills for two flights to Twitter in early November, but said Twitter never paid.
Marty O'Neill, Twitter's global head of strategic procurement, sent an email to PJS on November 16, saying that "Twitter is not responsible for these fees" because, according to the indictment, "only the company's designated representative" can book charter flights through PJS.
The lawsuit alleges that Twitter and PJS signed an agreement in 2020 requiring Twitter to book flights with airlines through "designated representatives", but the company "does not always follow this process" and has in the past allowed Twitter employees within the scope of non-designated representatives to book flights. PJS said Twitter breached the contract and refused to pay "if PJS had reason to believe".
The lawsuit alleges that Taylor DeLorenzo, a Twitter employee, booked one of the flights and replied to an email from O'Neill in November that the then chief executive, Parag Agrawal, had authorized him to book the flight.
According to the complaint, de Lorenzo wrote in an email: "the situation was very urgent in the week when the acquisition was completed, and Bolan was the main person in direct contact with Musk on Twitter."
O'Neill responded to de Lorenzo's email, saying that "no amount of emphasis can change the established view of the company's new management on this matter," the complaint said.
This is not the first time Twitter has refused to pay the bill since Musk took office. It was reported last month that some Twitter suppliers were owed millions of dollars. Musk's staff said the company did not intend to pay for these services because they were authorized by former management rather than Musk.
In recent months, Musk has taken a number of measures to cut Twitter operating costs, not only layoffs, but also the elimination of free lunches and online auctions of office equipment. Musk even put forward the idea of bankruptcy, warning that "the economic outlook for the future is terrible."
