According to the details of the case disclosed by the Supreme people's Procuratorate, the defendant Li is a software developer of a network technology limited company. From June to September 2020, Li created a software that can steal photos from the installer's phone. When the mobile phone user downloads and installs the software and opens it, the software will automatically obtain the photos of the phone album and upload them to the background of the server built by Li. Li posted the software on a forum on the dark network for sale, and as of February 9, 2021, it has sold a total of $30 virtual coins on the website. Later, in order to show off his technology and satisfy his vanity, Li disguised the software as "face detection" software and posted it on a forum for netizens to download and install for free, thus stealing 1751 photos of installers' mobile phone albums. Among them, it contains more than 100 pieces of personal information, such as face information, name, ID card number, contact information, home address and so on. In September 2020, Li used virtual coins to buy "social work database data" in the forum of the dark network and transferred it to the online disk. In February 2021, in order to show off his ability, knowing that the "social work database" contains household registration information, car owner information, etc., Li still shared the link to the "owner Exchange" QQ group (150members). After removing invalid data and merging to remove duplicates, the "social work database" contains more than 8100 pieces of personal information of citizens. On March 9, 2021, the public security organ arrested Li. After investigation, due to the huge content of the "social work database" and stored in the overseas network disk, no one was found to download and use it.

On March 26, 2021, the public security organ applied for approval for the arrest of Li. The Shanghai Fengxian District people's Procuratorate examined that Li illegally obtained and provided more than 8100 million pieces of personal information about citizens in the QQ group, and that the amount of information was huge, which was in line with the regulation of "particularly serious circumstances". Moreover, facts such as Li's use of "face detection" software to steal "face information" needed to continue investigation, and the case had the possibility of destroying evidence, so he approved the arrest on April 2.

On May 28, 2021, the public security organ referred the case for examination and prosecution. Fengxian District people's Procuratorate examined that Li illegally obtained and provided citizens' personal information, has been suspected of infringing upon citizens' personal information, and the amount of information conforms to the provisions of "the circumstances are particularly serious." in view of the fact that Li subjectively did not have the purpose of selling for profit, objectively did not cause the dissemination and diffusion of information, and was a first offense, he voluntarily pleaded guilty and accepted punishment on August 10. The people's Procuratorate of Fengxian District initiated a public prosecution for Li on suspicion of infringing upon a citizen's personal information and proposed a fixed-term imprisonment of three years with a suspended sentence of three years.

On August 23, 2021, Fengxian District people's Court conducted a public trial in accordance with the law. The Fengxian District people's Court held that Li had confessed circumstances, voluntarily pleaded guilty and pleaded guilty, dealt with him leniently in accordance with the law, and sentenced Li to three years in prison, suspended for three years, and fined for infringing upon a citizen's personal information.

Procuratorial organs remind that face information is biometric information that cannot be modified and unique.
