CTOnews.com December 7 news, the General Administration of Market Supervision announced today, in order to strengthen and standardize advertising supervision and law enforcement activities, in accordance with the "People's Republic of China Advertising Law,""People's Republic of China Administrative Punishment Law" and other laws, regulations, rules and relevant state provisions, combined with the actual advertising supervision work, the General Administration of Market Supervision formulated the "Advertising Absolute Terms Enforcement Guidelines (Draft for Comments)," is now open to the public for comments.

In any of the following circumstances, it is generally not considered to be a minor illegal act or less harmful to society: absolute terms related to curative effect, cure rate, effective rate, etc. appear in advertisements for medical treatment, drugs, medical devices, health food and formula food for special medical purposes; absolute terms related to investment return rate, investment safety, etc. appear in advertisements for financial products.

CTOnews.com understands that Article 9, paragraph 3, of the Advertising Law of the People's Republic of China stipulates that advertisements shall not use terms such as "national level,""highest level" and "best." Similarly, Paragraph 8 of Article 8 of the Measures for the Administration of Broadcasting of Radio and Television Advertisements reads: "Radio and television advertisements are prohibited from containing the following contents: using absolute language, deceiving and misleading the public, deliberately using wrong characters or tampering with idioms."

In addition, according to the Reply of the State Administration for Industry and Commerce on whether the word "best" belongs to "highest level" and "best" in advertising language,(Gong Shang Guang Zi [1997] No.207) and other relevant guidance opinions, the relevant person in charge of the Municipal Administration for Industry and Commerce explained that all the national, highest and best meanings explicitly prohibited by the new Advertising Law belong to absolute terms, such as "100% safe, 100% effective,""first brand,""top" and "out of print."
