In June and July, Amazon made concessions to the European Union, promising that it would allow sellers access to some marketplace data, while its commercial arm would not be able to use seller data collected by its retail division. Amazon also agreed to increase the visibility of rival products on its platform.

Amazon says it ranks sellers '"Buy Box" offers equally. Buy Box allows consumers to add items from specific retailers directly to their shopping cart, and on Amazon, getting a "buy box" means more sales.

In response to Amazon's proposed concessions, the European Commission then began soliciting feedback, and competitors and consumers have until September 1 to submit comments and suggestions. After that, the European Commission will decide whether to accept Amazon's proposal. Amazon hopes the EU will conclude its investigation by the end of the year.

Four people familiar with the matter said today that the European Commission plans to announce the settlement agreement on December 20. Of course, the final date could change. Amazon's commitments, which are valid for five years, have been "market tested" with competitors and approved by EU officials, these people said.

For the European Union, the settlement represents a victory for using the new Digital Markets Act to limit the power of big tech companies. Amazon avoided a hefty fine of up to 10% of global revenue.

As part of the settlement, Amazon will also allow sellers who use its Prime membership program to choose any logistics company and negotiate terms directly with it, rather than being restricted from using Amazon's logistics services.
