CTOnews.com, December 3, Apple today decided to countersue AliveCor in order to better protect its rights and interests. The dispute began in 2021, when AliveCor filed a complaint with the US International Trade Commission (ITC) alleging that Apple had infringed three ECG patents of AliveCor.
CTOnews.com learned that the two sides then went back and forth in court, and AliveCor filed a complaint with ITC earlier this year for an import ban on Apple Watch, and the judge ruled in AliveCor's favor.
Through this counterclaim, Apple hopes to clarify who is the pioneer of ECG-related patents and curb rampant infringement of AliveCor. Apple said in its counterclaim that Apple was the pioneer of the ECG patent and had studied, developed and patented the core basic technology before the advent of AliveCor. AliveCor's lawsuit is only through litigation to achieve the purpose of selling new ECG products.
Apple applied for a patent years before the birth of the AliveCor. The complaint cites several Apple patents related to the heart rate and ECG functions of the Apple Watch, which Apple claims are infringed by AliveCor's KardiaMobile, KardiaMobile Card and Kardia apps.
