Colombian court lifts ban: Apple can continue to sell 5G products such as iPhone 14 in the country

CTOnews.com, Nov. 17-Colombia banned the sale of Apple iPhone 14 and related 5G products in the country earlier this year for infringing a technology patent from Ericsson. Now, the Colombian appeals court has lifted the preliminary injunction, meaning Apple can continue to sell the iPhone 14 series and all its 5G devices.

CTOnews.com learned that in April 2022, Juzgado 042 Civil del Circuito de Bogota, based in Bogota, Colombia, ruled that Apple's 5G hardware infringed an Ericsson patent. As a result, in July 2022, the court issued a preliminary injunction banning Apple from selling any 5G devices in the country.

Citing FOSS Patents, the civil court of Bogota High Court decided to rescind the preliminary injunction and rejected the right from Telefonaktiebolaget LM Ericsson, a subsidiary of Ericsson in the country, to initially stop infringement and breach of contract.

The appeals court reportedly ruled that Apple provided additional arguments after the initial injunction was granted, and the court no longer held that it was reasonable to maintain the injunction.
