On the morning of November 9, Beijing time, it was reported that on Monday, local time, a US judge rejected the application of Elizabeth Holmes, founder of blood testing company Theranos and known as "female version of Jobs", for a retrial of the case. She will be sentenced next week for defrauding investors and could be jailed later this month.
In January, Holmes was convicted of four counts of fraud and conspiracy for conduct in the course of Theranos. In the months that followed, she tried to reverse the verdict and applied for a retrial three times based on the latest evidence.
However, according to Monday's court order, Northern California District Judge Edward Davila (Edward Davila) rejected her application, saying the evidence was not enough to meet the criteria for rehearing the case.
Holmes, 38, is expected to be sentenced on November 18. The maximum penalty for each charge of fraud is 20 years in prison.
At the trial last month, Holmes appeared to be pregnant with her second child. She is currently on bail and lives in Woodside, California, with her partner and son. She is expected to appeal after the verdict.
Holmes's lawyer did not respond to requests for comment.
Holmes had previously submitted new evidence to the court, including an unusual visit to her home in August by Dr. Adam Adam Rosendorff, a key witness for the prosecution. Holmes claimed that some of Rosendorf's statements at the time showed that there was something suspicious in his testimony, and then Judge Davila asked Rosendorf to appear in court again to confirm his testimony.
Last month, Rosendorf, a former director of Theranos's laboratory and who helped expose the company's fraud, said on the witness stand that he visited Holmes to help her end the matter.
Holmes's lawyer questioned Rosendorf's mental health and mental state during the trial. Based on what Rosendorf said during a visit to Holmes' home, the lawyer accused prosecutors of distorting the Theranos incident.
Rosendorf testified that his statements on the stand were accurate. During the four-month trial last year, he testified in court for six days. He also specifically pointed out that what he said was that Theranos's "everyone is working very hard to do something useful and meaningful", clearly excluding Holmes and her co-conspirator Ramesh Barvani (Ramesh Balwani).
In a 15-page court order on Monday, Judge Davila said he thought Rosendorf's affidavit was credible. In addition, other evidence provided by Holmes did not meet the criteria for retrial. He said Holmes's reasons were "not specific enough", "unconvincing" and that "even if a retrial is initiated, she is unlikely to be acquitted".
Barvani, 57, was convicted of 12 counts of fraud and conspiracy this summer, and his case will be sentenced on December 7.
