It turned out that Xiaoqi was reluctant to give up after selling the game account, so he spent 20 yuan on the Internet to buy the "account stolen recovery service", and then complained to the game platform operator, falsely claiming that his own game account had been stolen. Later, through the account bound to the original mailbox, mobile phone number and other information, successfully "restore" the above account, and re-set the password.

The court of first instance sentenced Xiaoqi to three years and six months' imprisonment and a fine of 50,000 yuan for larceny. Xiao Qi thought the sentence was too heavy and appealed to the Shanghai second Intermediate people's Court.

In the second trial, Xiaoqi argued: "the platform stipulates that accounts cannot be bought or sold at will, so I am not stealing, just getting my account back."

The court held that although game accounts and equipment exist in a special network environment, they also embody the labor achievements of players and have independent property value and practical usefulness. In addition, game accounts and equipment also have the possibility of being managed, can be transferred and traded in the market, and have both exchange value and use value. The real and realistic buying and selling of both sides of the transaction should be protected and relieved by law. Xiaoqi for the purpose of illegal possession, through the network to "retrieve" technology to steal game accounts and equipment that have been transferred and controlled by others, this behavior has constituted larceny.
