The deadline for feedback is November 27, 2022.

CTOnews.com learned that the Ministry of Industry and Information Technology said that China's issuance of the regulations on the Administration of production access permits for Road Motor vehicles (draft for soliciting opinions) will improve the level of network safety and data security protection of road motor vehicles, and promote the high-quality development of the road motor vehicle industry.

The regulations point out that the application for product access permits for road motor vehicles must first meet the requirements of safety, environmental protection, energy conservation and other standards and technical specifications. In addition, in terms of intelligent network connected vehicles, in order to meet the relevant standards of functional security, network security and data security, intelligent network connected automobile manufacturing enterprises should establish vehicle product network security, data security, personal information protection, car connection network card security management, software upgrade management system. The personal information and important data collected and generated by the intelligent network automobile manufacturing enterprise in the process of product sale and use shall be stored in China in accordance with the law. If it is really necessary to provide it overseas due to business needs, it shall go through the safety assessment organized by the state network information department in conjunction with industry, information and other relevant departments, and report to the relevant departments.

In the draft for soliciting opinions, Article 22 stipulates that for intelligent Internet-connected automobile products with self-driving function, the product instructions shall clearly inform consumers of the restrictions on the use of the vehicle autopilot function, the use of vehicle safety and emergency devices, the driver's duties, the relevant human-computer interaction equipment instructions and the activation and exit methods of the vehicle autopilot function. Article 23 makes it clear that product advertising shall not contain false or misleading contents such as exaggerating the performance of the product or confusing the actual manufacturer of the product.

In addition, the draft for soliciting opinions also stipulates that vehicle software upgrades (OTA) need to be put on record with the competent department in charge of Gongxin; for vehicle software upgrades related to road motor vehicle product safety, environmental protection, energy saving and other performance, the production enterprise shall not sell the vehicle software upgrade until the implementation of the software upgrade and the completion of the change of product access license.

According to the Financial Associated Press, the release of the draft for soliciting opinions has been little more than three years since the implementation of the previous version of the policy. Comparing the policies of the new and old editions, it is not difficult to find that the draft for soliciting opinions is not only issued in the form of management regulations, but also has a higher level and effectiveness than the 2018 version of the management measures, but also strengthens the vehicle network security, data security and personal information protection in the specific policy provisions. At the same time, the 2018 version of the provisions on encouraging "contract manufacturing" did not appear in the "consultation draft", which means that "contract manufacturing" mode may have been banned.
