After examination, the State intellectual property Office believes that the objected trademark "shaking donkey" is designated to be used in the 38th category of services such as "insurance information; insurance brokers". The dissenting party cited previously registered trademarks such as No. 21879720 and No. 47878995 "Douyin" for use in category 9 "computer programs (downloadable software); recorded computer operating programs" and other goods. There are certain differences in the functional use of goods and the content characteristics of services specified by both trademarks, which do not belong to similar goods or services, so the trademarks of both parties do not constitute similar trademarks used in similar goods or services. The dissenting party also cited the previously registered trademarks No. 28432227 "shake", No. 27829710 "Douyin" and other trademarks approved for use in Class 36 "Insurance Information; Stock and Bond Brokerage" and other services. The trademarks of the two sides have certain differences in terms of text composition, call, etc., and do not constitute an approximate trademark. Therefore, if the trademarks of both parties are not formed, they will be used in similar services, and the registered use of the dissenting trademarks generally will not cause confusion to consumers. In the end, the State intellectual property Office granted registration to the trademark No. 54285649 "shaking Donkey".
