According to news in the morning of September 28, Beijing time, Twitter said this week that Tesla CEO Elon Musk's own data scientists did not believe that the number of fake accounts on the Twitter platform, as Musk said, was "much higher" than the company's estimate. At present, the two sides are preparing for the upcoming litigation trial in October.

Mr Musk is trying to pull out of the $44 billion acquisition of Twitter. Musk had previously said that this was because the real number of fake and spam accounts on the Twitter platform far exceeded the 5% the company had said over the years, misleading regulators and investors.

At a three-hour Delaware court hearing on Tuesday, local time, Twitter's lawyers said documents they received during the evidence collection process showed that Cyabra and CounterAction, two consultants hired by Musk, estimated the number of spam accounts on the Twitter platform at 11% and 5%, respectively, which is basically consistent with the estimates made public by Twitter.

Lawyers for Twitter said the reports were submitted a day before Mr Musk announced plans to terminate the merger. In addition, although the conclusions reached are in favor of Twitter, Twitter still criticizes the research methods of the two data sets.

Twitter urged the court to force Mr Musk to share more information, that is, his own data science advisers' research into fake accounts on the Twitter platform. Twitter's lawyer said that although Mr Musk shared some details of the consultancy study, he had been "procrastinating and obstructing" over the past two months. Musk's lawyer denied the charges.

In addition, Twitter accused Musk's team of failing to submit chat records related to Signal, an encrypted communications app, and denying that Musk used the chat app. Twitter's lawyer mentioned that Musk had communicated with well-known investor Marc Andreessen via Signal in April, when the message was automatically deleted after a period of time.

Twitter also said Mr Musk's team had failed to submit text messages between Mr Musk and James Gorman, chief executive of Morgan Stanley, and Larry Ellison, founder of Oracle, before the trial.

Musk's lawyer denied deliberately concealing the content of the communication, saying it was a "minor mistake that could occur in the accelerated litigation process".

Twitter asked the court to punish Musk on the grounds that he had acted improperly in the release of information. This also includes the so-called "adverse corollary", in which the court can assume that Musk has concealed the details of the facts against him.

Delaware Chancery Judge Catherine McCormick (Kathaleen McCormick) did not immediately rule, saying she would consider it further after consulting a consultant. The five-day trial will begin on October 17th.
