CTOnews.com, September 19 (Xinhua) the U.S. Justice Department has asked to attend an appeal hearing on Epic's violation of Apple's App Store policy. Apple and Epic Games will return to court in October, with both sides appealing against all aspects of previous antitrust rulings.

Antitrust lawyers at the US Department of Justice have asked for a 10-minute oral debate during Apple's upcoming Epic Games appeal. The Justice Department wants to follow up on its previous written briefing, which concluded that the court had mistakenly determined that Apple was primarily beneficial.

Technically, the U.S. Justice Department is not on either side, but its argument supports Epic's argument that Apple's App Store violates antitrust law.

According to court documents seen by Reuters, officials from the United States Department of Justice asked to participate in the oral debate.

"the United States believes that its participation in oral arguments will help the courts, especially in explaining how errors (in the interpretation of antitrust law) seriously undermine antitrust enforcement outside the specific context of the case," according to the DoJ file.

Neither side opposed the move. But Apple said it hoped the Justice Department's debate time would offset the 10-minute debate time deducted from Epic.

CTOnews.com learned that although Apple won the Epic Games case, the company opposed the "anti-manipulation" clause in the ruling.

Epic insisted that the judge had made too many legal mistakes in her decision and was seeking a thorough retrial.
