Tesla, the electric car giant owned by Elon Musk, became the defendant in a proposed class action lawsuit on Wednesday, Beijing time reported. The lawsuit alleges that the company misled the public by falsely advertising its Autopilot and fully autonomous driving (Full Self-Driving) functions.
According to the accusation made by the plaintiff in the indictment, although knowing that self-driving technology does not work or does not exist at all, since 2016, Tesla and Musk have been fraudulently promoting that their self-driving technology is fully functional or "just around the corner", making their vehicles unsafe.
Briggs Matsko, the plaintiff, said Tesla's move was to make people "excited" about his car to attract investment, boost sales, avoid bankruptcy and push up share prices, thus becoming a "leader" in the field of electric vehicles.
"Tesla has not produced anything close to a fully self-driving car," says Mr Matzko. "
The lawsuit, filed in federal court in San Francisco, seeks compensation from Tesla for users who bought or rented Tesla cars with Autopilot, enhanced Autopilot and fully self-driving features since 2016, but did not specify the amount of compensation.
Tesla did not respond to a request for comment after the company disbanded its media relations department in 2020.
The lawsuit follows a lawsuit filed by the California Motor vehicle Administration (Department of Motor Vehicles) on July 28, accusing Tesla of exaggerating the operation of his Advanced driver Assistance system (ADAS). The remedies proposed by the lawsuit may include revoking Tesla's driver's license in California and seeking compensation for the driver.
Tesla has previously said that the Autopilot function allows the vehicle to turn, accelerate and brake in the lane, while the fully autopilot function allows the vehicle to obey traffic signals and change lanes.
The company also said that both technologies "require active driver supervision", which requires drivers to put their hands on the steering wheel and stay "fully focused" and "do not allow the vehicle to drive on autopilot".
The plaintiff in the lawsuit, Rancho Murieta of California, alleges that he paid a premium of $5000 for his 2018 Tesla Model X for enhanced Autopilot features.
He also said that Tesla's driver, who received the software update, was "actually like an untrained test engineer" and found "numerous problems" while driving, including driving into the reverse lane, running red lights and being unable to make regular turns.
Since 2016, the National Highway Traffic Safety Administration (NHTSA) has launched 38 special investigations into Tesla crashes believed to have involved an "advanced driver assistance system." It is reported that a total of 19 people were killed in these crashes.
