CTOnews.com, Sept. 7 (Xinhua) recently, the civil judgment of the second instance of the network tort liability dispute between Xu and Beijing World Xinghui Technology Co., Ltd. was made public, and Xu sued and asked the latter to lift the ban on his game account, according to the China referee Writing website.

Xu said he invested a lot of time and money in the game and never used a so-called plug-in program that "interferes with the fairness of the game" and "has the nature of cheating", so he sued the court for the game platform's refusal to unblock the account.

The game platform believes that Xu has almost uninterrupted game behavior for more than 8 days, 12 days and 20 days in half a year. Xinghui said that after background testing, Xu had many uninterrupted games between October 2020 and March 2021, which belonged to the illegal use of scripts, so he was banned.

The court held that, according to the analysis of background data, the plaintiff had a number of continuous games throughout the day from November 19, 2020 to November 24, 2020, November 28, 2020 to December 6, 2020, January 30, 2021 to February 3, 2021, March 4, 2021 to March 21, 2021, especially from March 3, 2021 to March 22, 2021. There is a total of 441 hours of almost uninterrupted games for more than 20 consecutive days, and the number of games per hour is about 10, which is larger than the normal number of games (about 5-7 games). This time curve seriously does not accord with the "physiological law" of human beings, and the number of game games accords with the characteristics of scripts, which is more similar to the completion of some automated script execution, so the defendant's evidence has a "high probability". It can also prove that the game behavior of the plaintiff at that time could not be completed by ordinary human beings. Therefore, the court held that the plaintiff used script behavior and rejected the plaintiff Xu's claim.

CTOnews.com learned that Xu then filed a second-instance appeal, and the Beijing Municipal fourth Intermediate people's Court upheld the original verdict.
