Shulou(Shulou.com)11/24 Report--

According to news in the morning of Sept. 7, Beijing time, this week, Elizabeth Holmes (Elizabeth Holmes), the heroine of "Bad Blood" and founder of blood testing company Theranos, asked for a retrial of her fraud case. She said that a key witness in the case visited her after the verdict and expressed doubts about the testimony provided.

On Tuesday, local time, Holmes said in a court filing that Adam Rosendorff, the former director of Theranos Lab, visited her home before August 8 and pointed out that he suspected that his testimony last fall had been distorted by prosecutors.

Documents show that Rosendorf arrived in front of Holmes's house at around 6 p.m., where Holmes's partner, Billy Evans, met him and found him "dishevelled" with a dishevelled shirt and hair. The two had a brief conversation. Evans wanted him to leave, while Rosendorf insisted on meeting Holmes. According to Evans, Rosendorf said he wanted to help Holmes. His voice trembled "slightly" at that time.

The lawsuit against Theranos and Holmes is one of the most high-profile cases in Silicon Valley history. It has been eight months since Holmes was convicted of fraud and she is expected to be sentenced within weeks.

During the Holmes trial, Rosendorf testified that he had emailed Holmes and raised concerns that Theranos's blood analyzer was not ready for commercial promotion at the Walgreens drugstore.

According to Holmes' filing on Tuesday, when Rosendorf spoke to Evans, he said, "he tried to answer the questions in the trial honestly, but the prosecutor tried to make everyone look bad."

"whatever interpretation of his claims, they deserve a retrial," Holmes's lawyer said in the document. " At the very least, the court "should order an evidentiary hearing and allow Holmes to subpoena Rosendorf to testify on the concerns he expressed".

However, some legal experts pointed out that the doubts expressed by Rosendorf did not involve his lying or inaccurate testimony, so the judge may not be able to persuade the judge to reopen the trial.

Holmes, 38, founded the once-hot blood testing company Theranos, which was valued at $9 billion at its peak, but soon went bankrupt. Holmes was subsequently convicted of defrauding investors and conspiracy. Her ex-boyfriend, Ramesh Balwani, the former president of Theranos, was convicted of similar charges and fraud in July.

After leaving Theranos in 2014, Rosendorf became laboratory director of uBiome, a Silicon Valley healthcare startup. Like Theranos, the company failed in a quagmire of bankruptcy, regulatory investigations and criminal charges. There is evidence that Rosendorf was one of the sources of information in the media revelations about Theranos in 2015.
